Gekas, by and through thier attorneys, Caldwell & Kearns, and files the within Complaint; and in support thereof, avers as follows: 1. Plaintiff, Dean Gekas, also known as Constantine N. Gekas, is an adult individual currently residing at 48 South Terrace Road, W ormleysbnrg, Pennsylvania 17043. 2. Plaintiff, Evan N. Gekas, is an adult individual currently residing at 1045 Laurian Park Drive, Rosewell, Georgia 30075. 3. Defendants, Chester J. Jasek and Lois M. Jasek, husband and wife ("Defendants"), are adult individuals currently residing at 460 Brentwater Road, Camp Hill, Pennsylvania 17011. It is further believed, and therefore averred, that Defendants' last names were misspelled in the Notice of Judgment from the Magisterial District Judge as "Jesek." 3 1-- 4. On or about July 6, 2004, Plaintiffs and Defendants entered into a Standard Agreement for the Sale of Real Estate, ("Agreement"), for Plaintiffs' pnrchase of Defendants' home located at 460 Brentwater Road, Camp Hill, Pennsylvania, ("the Property"). A true and correct copy of the Standard Agreement for the Sale of Real Estate is attached hereto as Exhibit "A" and incorporated herein by reference. 5. The Agreement provided that Plaintiffs would tender One Hundred Thousand ($ 100,000.00) Dollars plus all closing costs in consideration for the Property. 6. Plaintiffs and Defendants also entered into an Addendum to the Agreement, on or about July 9, 2004. A true and correct copy of the Addendum is attached hereto as Exhibit "B" and incorporated herein by reference. 7. The Addendum provided, inter alia, that the Seller (Defendants) had the option to rent the Property for three (3) years for the sum of Five Hundred ($500.00) Dollars per month, with a yearly increase based upon the New York Prime Rate plus three (3%) percent. 8. It was further agreed upon between the parties that Defendants could continue to reside at the Property, while paying a reduced rent, until such time that they could obtain financing and repnrchase the Property. 9. On or about July 9,2004, the property was conveyed from Defendants to Plaintiffs via Special Warranty Deed. A true and correct copy of the Deed is attached hereto as Exhibit "e" and incorporated herein by reference. COUNT I - BREACH OF CONTRACT 10. Plaintiffs hereby incorporate the averments of paragraphs 1 through 9 as if fully set forth herein. 4 11. Defendants paid the required rent from the time of transfer up to the rent owed for May 2005. 12. From May 2005, to date, however, Defendants have failed to tender monthly rental payments. 13. Despite repeated demands made by Plaintiffs, Defendants have failed and continue to fail to tender the required lease payments. 14. To date, Defendants are in arrears in an amount of Nine Thousand Five Hundred Dollars ($9500.00), plus reasonable late fees and interest. COUNT II - EJECTMENT 15. Plaintiffs hereby incorporate the averments of paragraphs 1 through 14 as if fully set forth herein. 16. Despite repeated demands, Defendants have failed to pay rent remaining due and unpaid. 17. As a result of Defendants' failure to tender rental payments, on or about March 18, 2006, an Eviction Notice was fastened to the Property in order to give Defendants notice of eviction. A true and correct copy of said Eviction Notice is attached hereto as Exhibit "D" and incorporated herein by reference. 18. Defendants have breached the terms of the Addendum by failing to meet their rental obligations. 19. The Defendants retain the subject Property and refuse to give up its possessIOn. 20.
