For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 3%
[72 P.S. S9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. S9116 (a) (1.1) (ii)].
The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent,
or a stepparent of the child is 0% [72 P.S. S9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. S9116(1.2) [72 P.S. S9116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. S9116(a)(1.3)]. A sibling is defined, under Section 9102, as an
individual who has at least one parent in common with the decedent, whether by blood or adoption.

Wilson, his wife, and Betty L. Fenicle and Douglas A. Fenicle, her husband, by deed
dated April 4, 1990, and recorded April 16, 1990, in the Office of the Recorder of Deeds
of York County, Pennsylvania, in Deed Book Vol. 105-Y, Page 581, granted and
conveyed unto Samuel E.Jamieson and Nancy J. Jamieson, his wife.
Samuel E. Jamieson and Nancy J. Jamieson entered into an installment sale
agreement dated Aufust 1, 1990, with Stephanie A. Boyd, wherein they agreed
to sell the property to Stephanie A. Boyd for the sum of $127,799.04. The unpaid
balance due under the installment sale agreement as of October 13, 2005, was
$98,028.62. Nancy J. Jamieson died December 1, 1998, whereby title to the aforesaid

BEGINNING at a point on the eastern right-of-way line of Kunkles Mill
Road, said point of BEGINNING being at the northweste~n corner of Lot
No.8, said point of BEGINNING also being coincident with the
northwestern corner of Lot No. 8 and the southwestern corner of Lot
No. 7 on the aforesaid subdivision plan, and at the western terminus

This agreement is subject to the following conditions:
1. The terms "Selle!::;" dnd "buye!::;; shall be deemed to include the signatories
hereto, their heirs, executors, administrators, successors or assigns; the
plural shall include the singular form if such be necessary.
2. The parties hereto agree to be legally bound hereby in accordance with the
acts of assembly of the Commonwealth of Pennsylvania. This shall be deemed to
be a Pennsylvania contract.
3. Sellers hereby agree to convey the above described real estate, intended
to be so described, together with all the buildings and improvements thereon
erected including, but not limited to, drains, stoves, fixtures attached to
the floors, ceilings and/or walls, windows, screens, shrubs, bushes, trees,
fences, pipes, and such easements and other rights that run with the land.
4. Sellers agree to give, grant, bargain and convey good and marketable title
thereto, in fee simple such as will be insured by any responsible title
insurance company at reasonable rates at regular rates, free and clear of any
liens or encumbrances except existing utility easements and zoning
restrictions, if any.
5. Sellers warrant that there are presently no mechanic's or materialman's
liens against the property or that same will be paid at or before settlement
and satisfactory proof thereof adduced at or before settlement and they do
further warrant that there are no outstanding bills for work done or notices
thereof which might result in mechanic's or materialman's lien or liens.
6. Sellers warrant that there are no notices of condemnation and further that
they will assign any and all rights to condemnation monies by reason of any
taking to buyers upon completion of settlemenl awl will include such a clause
in the deed or other separate instrument.
7. Sellers agree Hol to further encumber title nor to place any further
restrictions upon title.
8. Sellers agree to give possession of the property to Buyers substantially
in the same condition as at present, reasonable wear and tear only excepted,
on the date set forth herein, broom clean and free of trash, debris or other
noxious material.
9. Sellers and Buyers agree to share any tax or taxes imposed for transfer or
recording of any instruments necessary to effectuate this agreement except
recording charges. Sellers to assume liability for the Pennsylvania Transfer
Tax not to exceed one-half of total transfer or recording tax.
10. Buyers and Sellers agrees to apportion taxes as of the date of settlement
on a per diem basis.
11. The preparation of the deed transferring the aforementioned shall be the
sole responsibility of the Buyers, who shall bear the cost thereof as well as
the cost of acknowledgment.
12. Sellers warrant that there are no outstanding notices of taking by any
condemning authority or company.
13. Immediately after settlement, Buyers agree to forthwith record in the
office of the Department of Records or the Recorder of Deeds of the county in
which the subject property is located the executed deed and to pay the
recording charge or fee thereof.
14. Buyers agree not to lodge this agreement for record and, if the same is
done, Selle!:::> l1laj, at their option, forthwith declare this agreement null,
void and of no effect whatsoever and Buyers hereby authorize and empower
Sellers to appoint the Prothonotary, clerk or any attorney to appear for
Buyers in any court of record, as of any term, to enter his appearance for
Buyers and to admit any and all allegations made in any Complaint to quiet
title, to confess judgment against Buyers, and/or to enter into any
stipulation or stipulations or agreements necessary to quiet title, to waive
any right to a jury trial, rights to file exceptions or to appeal therefrom,
and Buyers agree to be bound thereby.
15. In the event that the Sellers are unable to convey in accordance with the
terms of this agreement, Sellers shall promptly notify Buyers in writing by
certified mail and Buyers shall then have the option of taking the property

16. In the event that Buyers are unable, unwilling, fail or neglect to make
settlement, Seller shall have the right to retain any and all monies paid as
liquidated damages and this agreement shall be null, void and of no effect
whatsoever.
17. Formal tender of keys and/or deeds is hereby waived.
18. Buyers shall not assign, pledge or hypothecate this agreement in any
manner whatsoever except in writing, executed by both Buyers and Sellers.
19. It is understood that time is of the essence. Settlement shall be made
at such hour and place as selected by the Buyers, provided the same shall be
within a reasonable distance of the property in question, on a weekday,
between 9:00 A.M. and 5:00 P.M. (unless otherwise agreed upon in writing by
the parties).
20 Sellers agree to execute any and all necessary documents for Buyers to
obtain title insurance. Title report and/or abstract to be provided by either
party to the other as quickly as possible, not less than 10 days prior to
set tl ement.
21. Risk of loss by fire or other casualty shall be upon buyers. If the
premises is insured, and such loss or casualty occurs, Sellers shall be paid
the balance due in full from the proceeds of the insurance policy or the
proceeds may be used to restore the premises to the same condition as before
the loss occurred. Sellers shall be notified, in writing, of the Buyers
decision by certified mail within (7) days to exercise such option,
irrespective of settlement date.
22. Buyers agree to carry a sufficient amount of liability insurance on the
herein described property.
23. Buyers agree that they are buying the property in an as is condition and
assume the responsibility for any and all necessary repairs
Clauses number (1) to (23) inclusive, contained on pages attached hereto,
irrespective of sequence, are hereby incorporated in and made a part of this
agreement at the execution hereof as though set out on this page in full.
THIS AGREEMENT REPRESENTS THE ENTIRE AGREEMENT BETWEEN THE PARTIES HERETO.
THERE ARE NO COLLATERAL OR ORAL AGREEMENTS.
