McKENRICK, his wife, Owners versus HOMES-R-US, a Pennsylvania General Partnership Contractor 1N THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA 02- ]~.~ MLD TERM, Whereas, Darrell E. McKenrick and Kimberly E. McKenrick, his wife, of 646 Walnut Bottom Road, Unit B, Shippensburg, Cumberland County, Pennsylvania are about to execute contemporaneously herewith, a contract with Homes-R-Us, a Pennsylvania General Partnership, of 640 Walnut Bottom Road, Shippensburg, Cumberland County, Pennsylvania, for the erection of a dwelling house upon a lot of land situate in Southampton Township, Cumberland County, Pennsylvania, being known as 1711 Rimer Highway, Shippensburg, PA 17257, with legal description as follows: ALL THE FOLLOWING described real estate, lying and being situate in Southampton Township, Cumberland County, Pennsylvania, bounded and limited as follows: BEGINNING at a parker-kalon nail located in the centerline of U.S. Route #11 (S.R. 0011) at the comer of Lot #2 as is shown on the land subdivision plan hereafter referred to; thence through the centerline of U.S. Route # 11 (S.R. 0011), South 55 degrees 38 minutes 44 seconds West, 200.00 feet to a parker-kalon nail located at the comer of Lot #4 and also at the comer of Lot #1; thence by said Lot #4, North 34 degrees 21 minutes 16 seconds West, 275.00 feet to an iron pin to be set at Lot #10; thence by said Lot #10, North 55 degrees 38 minutes 44 seconds East, 200.00 feet to an iron pin to be set at the comer of Lot #2; thence by said Lot #2, South 34 degrees 21 minutes 16 seconds East, 275.00 feet to a parker-kalon nail located in the centerline of U.S. Route #11 (S.R. 0011), the Place of BEGINNING. CONTAINING an area of 1.263 acres or 55,000 square feet and being designated as Lot #3 on a land subdivision plan made for Ressler's Walnut Bottom Farm by Dennis E. Black Engineering, Incorporated, Registered Surveyor, dated October 12, 1989. Said land subdivision plan, together with all required subdivision approvals noted thereon, is recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Plot Plan Volume 60, Page 24. Now, March 12, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with them and the further consideration of one Dollar, to Contractor paid by Owners it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
