HELMICK, deceased : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA : ORPHANS' COURT DIVISION : NO. 2005-00364 PETITION TO ESTABLISH DEATH OF ABSENTEE WITHOUT THE APPOINTMENT OF A MASTER IN ACCORDANCE WITH 20 Pa. CSA Section 5701 TO THE HONORABLE, THE JUDGES OF THE SAID COURT: The Petition of Brenda L. Kern, Executrix of the Estate of Ruth P. Helmick, states that: 1. Petitioner is the Executrix of the Estate of her late grandmother, Ruth P. Helmick, who was late of Carlisle Borough, Cumberland County, Pennsylvania. The decedent, Ruth P. Helmick, died on April 12, 2005, having left a Last Will and Testament dated December 4, 2002, a copy of which is attached hereto and marked as Exhibit "A". 2. Under Paragraph 5(c) of the Last Will and Testament of Ruth P. Helmick, ten (10%) percent of the decedent's estate is given and bequeathed to her granddaughter, Bonita A. Johnson, a presumed decedent. 3. The said Bonita A. Johnson, also known as Bonita A. Sanders, is an adult individual, age 43, having been born on December 24,1961. \ \ ~.~ --- 4. The last known residence of Bonita A. Johnson alk/a Bonita A. Sanders was 2599 Herr Street, #3, Harrisburg, Dauphin County, Pennsylvania 17109. 5. The presumed decedent, Bonita A. Johnson alk/a Bonita A. Sanders, left this address, it is believed, in the summer of 2004 and has been absent and unheard of since that time, and Petitioner believes her to be deceased. 6. The circumstances surrounding the disappearance and continued absence of the presumed decedent, Bonita A. Johnson alk/a Bonita A. Sanders, are that the presumed decedent was involved in a fire in her apartment at 2599 Herr Street, #3, Harrisburg, PA 17109 in August 2004. It is further believed by Petitioner that the presumed decedent was treated for her injuries at Johns Hopkins Hospital in Baltimore, Maryland and is believed by Petitioner to have been severely injured as a result of the fire. 7. There also exists an outstanding bench warrant for her arrest in Dauphin County. Presumed decedent failed to appear for a court hearing scheduled to be held on September 9,2004. 8. Petitioner, through her attorney, Jean D. Seibert, Esquire, has attempted to locate the said Bonita A. Johnson, through Internet inquiries such as USA Trace.com, but no updated address was provided. A copy of the results of the USA Trace.com search is attached hereto and marked as Exhibit "B". 2 '-- 9. Petitioner, through her attorney, Jean D. Seibert, Esquire, has also enlisted the assistance of the Office of Dauphin County Sheriff, Jack Lotwick, who has been searching for the presumed decedent, Bonita A. Johnson, a/k/a Bonita A. Sanders, and the Sheriffhas also reported not being successful in locating the individual, using either one of those names in his search efforts. A copy of the results of the Sheriffs records regarding same is attached hereto and marked as Exhibit "C". 10. First class mail addressed to presumed decedent has also been sent and returned from 2599 Herr Street, #3, Harrisburg, PA 17109, and from 524 Marcel Drive, Harrisburg, PA 17109, and from 226 Woodbine Street, Harrisburg, P A 17110, other addresses at which the said Bonita A. Johnson a1k/a Bonita A. Sanders was known to have resided prior to her last residence. Copies of the returned envelopes are attached hereto and marked as Exhibits "D-l, D-2 and D-3". 11. The presumed decedent is survived by her father Irvin M. Sanders, and her mother, Shirley A. Knisley, and two sisters, Petitioner, Brenda L. Kern, and Deborah K. Sufrin. 12. Under the terms of the Last Will and Testament of Ruth P. Helmick, paragraph 5: "If any of these beneficiaries should predecease me, I direct that their issue shall be in receipt of their share, per stirpes." 13. To the best knowledge of Petitioner and family of the presumed decedent, the presumed decedent, Bonita A. Johnson a/k/a Bonita A. Sanders, has no issue. Under the terms of the intestate law of the Pennsylvania Estates & Fiduciaries Code, her death without issue would mean that Shirley A. Knisley, daughter of Ruth P. Helmick, the decedent whose Estate is being distributed, would be in receipt of the share of Bonita A. Johnson. 14. The father and mother of the presumed decedent, referenced above, are owed money by the presumed decedent due to previous financial difficulties of the presumed decedent, in the amount 3 '-- of $2,838.64 to father and $730.50 to mother, respectively. 15. The father and mother have each executed an affidavit setting forth, to the best of each of their recollections, the date on which each of them last had contact with the presumed decedent, either by telephone or in person contact. The affidavits are attached hereto and marked as Exhibits "E-l and E-2". 16. 20 Pa. CSA Section 5704 requires that the Court order advertisement of a hearing on the Petition, a proposed form for which is attached hereto as Exhibit "F". 17. The presumed decedent's parents, the Petitioner and her sibling, all as parties of interest in the estate of the presumed decedent, have received notice of the intended presentation of this Petition and join in the prayer, a copy of which joinders are attached as Exhibit "G-l, G-2, G-3 and G-4", respectively. WHEREFORE, Petitioner requests that the Court: A. Set a hearing date for the purpose of declaring Bonita A. Johnson a/kJa Bonita A. Sanders, a presumed decedent. B. Order the advertisement of the filing of the Petition and the hearing date thereon in the form attached to this Petition in a newspaper of general circulation in Harrisburg, the last city of residence of the presumed decedent, Bonita A. Johnson a/kJa Bonita A. Sanders, and in the Dauphin County Reporter, Harrisburg, Pennsylvania, the legal publication 4 of Dauphin County to be done weekly for four successive weeks, the last appearance of which shall be at least two weeks before the hearing. C. Order the payment of all expenses of the preparation and filing of this Petition to the law firm of Wi on, Zulli & Seibert and any indebtedness owed by Bonita A. Johnson a/k/a Bonita A. Sanders to her parents, Irvin M. Sanders and Shirley A. Knisley, to be made from the residuary bequest of Bonita A. Johnson, the presumed decedent before any payment be made to her, should the said Bonita A. Johnson a/k/a Bonita A. Sanders be located, or any payment be made under the terms of the Pennsylvania Estates & Fiduciaries Code, should the said Bonita A. Johnson a/k/a Bonita A.
