COMES NOW Shana Smith and Symetra Assigned Benefits Service Company,
Transferee, (hereafter "SABSCO"), pursuant to the Pennsylvania Structured Settlement
Protection Act, 40 P.S. ~ 4001, et seq. (hereafter "the Act"), and file this Joint Petition for Order
Granting Application for Court Approval of a Transfer of Structured Settlement Payment Rights,
and state the following in support:

2. Co-Petitioner and Transferee SABSCO is a Washington corporation with its
principal place of business in Bellevue, Washington, and is also the structured settlement obligor.
3. Concurrently with this Joint Petition, SABSCO filed an Application for Court
Approval of a Transfer of Structured Settlement Payment Rights (the "Application"). A true and
correct copy of the Application is attached hereto as Exhibit "A" and incorporated herein by
reference.
4. Transferor/Payee, Shana Smith, has requested and concurs with the Application.
WHEREFORE, Shana Smith and Symetra Assigned Benefits Service Company jointly
request that this Court enter an Order granting the Application for Court Approval of a Transfer
of Structured Settlement Payment Rights.

Upon an application for Court Approval of a Transfer of Structured Settlement
Payment Rights ("Application") duly brought by Symetra Assigned Benefits Service
Company as Transferee ("SABSeO"), and the Court having considered documents in
support herein and written submissions, if any, filed by said interested parties named

The Court, upon said Application, hereby makes the following findings:
I. That the transfer sought to be approved complies with the requirements
of the Pennsylvania Structured Settlement Protection Act, PA St. 40 ~ 4001, et seq.
(hereafter "the Act"), 26 V.S.C. ~ 5891, and does not contravene any applicable
statute or order of any court or other government or responsible administrative
authority;
2. That said transfer is in the best interest of Shan a Smith,
TransferorlPayee, taking into account the welfare and support of Shan a Smith's
dependents (if any);
3. That Shana Smith has been advised in writing by SABSCO, Transferee,
to seek independent legal advice regarding the transfer and has received said advice
or expressly and knowingly waived said advice in a separate written
acknowledgment;
4. That SABSCO has provided the Disclosure Statement as required by
the Act to Shana Smith;
5. That SABSCO has provided Shana Smith with a copy of the transferee's
application, with attachments, a copy of the notice and proposed order; and
6. That SABSCO has provided written notice of said Application to the
Annuity Issuer, the Structured Settlement Obligor, and other interested parties as
required by the Act, none of whom have submitted written objections to said transfer.
Based on the foregoing findings, it is hereby ORDERED, ADmDGED, AND
DECREED that the transfer of the structured settlement payment rights, as described

It is FURTHER ORDERED that, pursuant to the Act, by making and

Annuity Issuer and Structured Settlement Obligor are hereby ordered to remit
the following periodic payments, to wit: $25,000.00 lump sum payment due October
28,2006 and $57,661.81 lump sum payment due October 28, 2008 to:

SABSCO shall service the payment and remit $48,611.81 to Payee.
The Transferred Payments, as described in the "Purchase and Sale Agreement"
filed with the Application herein, shall be paid to SABSCO regardless of whether
Shana Smith is alive or deceased when the Transferred Payments become due.
This Order is entered without prejudice to the rights of Symetra Life Insurance
Company and/or Symetra Assigned Benefits Service Company and the Court makes no
finding regarding the enforceability of any non-assignment provisions contained in
the original settlement agreement or related documents. This Order in no way
modifies or negates the ownership or control of the underlying annuity contract by
Symetra Life InslU"llllce Company and/or Symetra Assigned Benefits Service Company.
It is further ordered that the Structured Settlement Obligor and Annuity Issuer
shall irrevocably change the beneficiary for the Transferred Payments to SABSCO

Symetra Assigned Benefits Service Company and Symetra Life Insurance
Company shall provide formal acknowledgement of the terms of this transfer within
10 days of the date of receipt of this Order. The formal acknowledgement letter shall
be delivered to SABSCO at PO Box 34734, Seattle, Washington 98124.
This Order concludes the proceedings herein.

single. Payee has two dependents her children Ja'maury McKeithen age 3 1/2 and
Promise Hill age 8 months.

4. Transferee SABSCO is a Washington corporation with its principal place
of business in Bellevue, Washington.
5. Shana Smith is entitled to structured settlement payments as the result of a
structured settlement agreement entered into on 24 August 1999 ("Settlement
Agreement").
6. The Settlement Agreement resolved claims by Payee for compensation for
personal injuries or sickness. The Settlement Agreement provided for periodic
payments as follows: $100.00 monthly payment due on October 28, 1999 and on the
28th say of each following month until 48 payments have been made, guaranteed;
$20,000.00 lump sum payment due October 28, 2003, guaranteed; $25,000.00 lump
sum payment due October 28, 2006, guaranteed; $57,661.81 lump sum payment due
October 28, 2008, guaranteed. A true and correct copy of the Settlement Agreement is
attached hereto as Exhibit A.
7. Liability to make structured settlement payments pursuant to the
Settlement Agreement, was assigned, through a qualified assignment within the
meaning ofIRC ~ 130, to SABSCO.
8. To fulfill its obligations under the qualified assignment, SABSCO
purchased an annuity from Symetra Life Insurance Company, naming Shana Smith as
Payee on the above described payments.

9. Under the terms of the annuity, Symetra Life Insurance Company is
obligated to make the periodic payments to payee but the Structured Settlement
Obligor remains the owner of the annuity.
10. Shana Smith desires to sell a portion of the periodic payments, as follows:
$25,000.00 lump sum payment due October 28, 2006 and $9,000.00 out of
$57,661.81 lump sum payment due October 28,2008 (i.e. "Transferred Payments").
11. After receipt of the Disclosure Statement, not less than 10 days beforehand,
as required under PA St. 40 9 4003(a)(2), Payee entered into a Purchase and Sale
Agreement with SABSCO on 14 March 2006, in which Payee agreed, subject to the
court's approval, to sell the Transferred Payments.
12. Payee has represented that Transferred Payments have not previously been
sold, assigned, encumbered, conveyed or pledged, and that Payee has all right, title
and interest in the Transferred Payments.
13. Payee has agreed to irrevocably change the beneficiary of the Transferred
Payments to SABSCO or its designee.
14. The Purchase and Sale Agreement complies in all respects with the
requirements ofPA St. 4094001, et seq. A true and correct copy of the Purchase and
Sale Agreement is attached hereto as Exhibit B.
15. Not less than 10 days prior to the date on which Payee executed the
Purchase and Sale Agreement, SABSCO provided Payee with a disclosure statement
setting forth in the information required by law. A true and correct copy of the
disclosure statement is attached hereto as Exhibit C.
16. Shana Smith was advised in writing by SABSCO to seek independent legal
advice regarding the financial, legal, and tax implications and ramifications of the

transfer, and she knowingly and voluntarily chose not to seek such advice in writing.
A true copy and correct of waiver to that effect is attached hereto as Exhibit D.
17. Not less than 20 days prior to the hearing date, SABSCO provided notice
through service on all interested parties, pursuant to PASt. 40 S 4004, identified in
paragraphs I through 4 above, the following documents: a copy of the petition and
rule to show cause, a copy of the application, a copy of the transfer agreement, a copy
of the disclosure statement, a copy of the notice of date, time and place of hearing, a
copy of the notice to all interested parties, and a [proposed] order, as set forth in Exhibit
E.
18. Shana Smith intends to use the funds from this transfer to payoff a few
collection accounts and fund a down payment on a home. The proceeds are not
required for daily living expenses. A true copy of the Affidavit of Payee is attached
hereto as Exhibit F.
19. The transfer of structured settlement payment rights is in the best interests
of Payee, taking into account the welfare and support of Payee's dependents, ifany.
20. The transfer of structured settlement payment rights described herein and
in the Purchase and Sale Agreement complies with the requirements of the Structured
Settlement Protection Act PA St. 40 S 4001, et seq, 26 V.S.C. S 5891, and does not
contravene any applicable statute, or the order of any court or other governmental
authority.
21. SABSCO reserves its right to assign the Transferred Payments to another
entity.
22. Shana Smith desires to irrevocably change the beneficiary of the transferred
payments to SABSCO or its successors or assigns.

24. Venue is appropriate in Cumberland pursuant to PA S1. 40 S 4004 as Shana
Smith resides in Cumberland County.

WHEREFORE, Transferee, SABSCO, respectfully requests the Court enter an
order approving this application and the transfer of structured settlement payments
rights, described herein and in the Purchase and Sale Agreement, to SABSCO.

Purchase and Sale Agreement
I. Parties:
This purchase and sale agreement is between Shana Smith ("SELLER"), 2205
Cedar Run Drive Extended Apartment B, Camphill, Pennsylvania 17011, and
Symetra Assigned Benefits Service Company, ("PURCHASER") 777 IOalll
Avenue, NE, Suite 1200, SC-IO, Bellevue, WA 98004-5135, a Washington
Corporation or its designated assigns.
2. Definitions:
2.1 "Payee" means an individual who is re<::eiving tax free payments under a
strUctured settlement and proposes to make a transfer of payment rights;
2.2 "StrUctured Settlement" means an arrangement for periodic payment of
compensation for personal injuries or sickness established by settlement or
judgment in resolution of a tort claim;
2.3 "Structured Settlement Agreement" means the agreement, judgment,
stipulation, or release embodying the tenus of a strUctured settlement;
3. Recitals:
3.1 SELLER is the "payee" under a "structured settlement agreement" agreed to
between SELLER and York Insurance Company.
3.2 York Insuranee Company assigned its liability to make the payments. through
a qualified assignment within the meaning of Section 130 of the U.S. Internal
Revenue Code, to Symetra Assigned BeneHt Service Company ("SABSCO")
which funded its obligation by buying an annuity issued by Symetfa Life
InsUl"<ll1ce Company ("Symetra Life").
3.3 The "strUctured settlement agreement" is listed in Exhibit "A" of this
agreement The payments being sold by this agreement are listed in Exhibit
"B" of this agreement. A copy of the Disclosure Statement provided by
PURCHASER to SELLER is attached as Exhibit "e" of this agreement.

5.3 SELLER acknowledges that this lI'llllSfer will take several weeks to complete
and requires court approval. Seller agrees to cooperate to obtain eourt
approval of this sale and to take steps in good faith to effectuate this
agreement. Seller acknowledges and understands that Purchaser has no
obligation to pay the purchase price unless and until a final court order
approving the sale is granted.

4. Agreement:
4.1 THEREFORE, contingent upon court approval under applicable statutes,
SELLER agrees to sell the payments listed in Exhibit "B~ of this agreement to
PURCHASER, for the amount of T\venty-Eight Thou.<;and, Seven Hundred
Forty-Nine Dollars and Ninet)'-Four Cents ($28,749.94). SELLER affirms
that the pa}ments listed on Exhibit "B" to this agreement are free from all
charges and encumbrances.
4.2 SELLER agrees that in the event SELLER receives any of the payments listed
in Exhibit "B" from the annuity issuer or the structured settlement obligor
prior to the closing and court approval of this agreement, PURCHASER may
deduct the aggregate amount of the payments so received by SELLER Itom
the agreed purchase amount. In the event one of the purehased payments is
sent to Seller after the court approval of this agreement is received, SELLER
agrees to hold the payment in truSt for Purchaser and to immediately turn over
such payment(s) to Purchaser.
4.3 SELLER agrees to revoke any prior beneficiary designation related to the
payments being sold, and agrees to name PURCHASER, or its designee, as
irrevocable beneficiary.
4.4 In order to effectuate the purposes of this agreement, SELLER grants a
security interest (lien) upon all the of SELLER's right, title and interest to the
purchased payments to PURCHASER. SELLER further authorizes
PURCHASER to file financing statements regarding the purchased payments
to secure PURCHASER'S rights hereunder.
5. SELLER Acknowledgements and Warranties:
5.1 SELLER acknowledges that PURCHASER has advised that SELLER seek
independent professional advice, including legal and accounting advice,
regarding this lI'llllSfer.
5.2 SELLER acknowledges that this transfer is in his or her best interest, taking
into account the welfare and support of his or her dependants.

5.4 SELLER warrants that he or she has the power and right to enter into this
agreement and has not sold or assigned his or her right to receive the
payments, listed in Exhibit "B~ of this agreement, previously and that the
payments listed in Exhibit "B" are not affected by any mortgage, pledge, lien,
charge, security interest, encumbrance, restriction or advcrse claim of any
kind.
5.5 SELLER warrants that he or she does not owe any money to his or her spouse
or former spouse for alimony, maintenance, and/or child support. SELLER
also warrants that he or she is current in any child support obligation and does
not owe any money to any guardians of children or state agency for back child
support.
5.61f Seller owes any past child support, or has recorded judgments or liens which
encumber the purchased payments, Purchaser may, in its sole discretion, pay
those debts and deduct the amount paid lrom the purchase price at the lime of
closing. This agreement in no way creates any obligation by SABSCO to pay
such encumbrances, directly or indirectly.
5.7 SELLER is fully aware ofhislher rights under the "structured settlement
agreement," and this purchase and sale agreement, and agrees that upon court
approval, this purchase and sale agreement terminates any rights SELLER or
any of hislher beneficiaries. heirs, spouse, assigns, agents or representatives
have or claim to have in the payments sold.
5.8 SELLER agrees to provide, or assist PURCHASER in obtaining, the following
documents.

c. SELLER's Affidavit
d. Consent of Spouse (i I' applicable)

This agreement is governed by the laws of the state of Pennsylvania.

2. That said transfer is in the best interest of Shana Smith,
Transferor/Payee, taking into account the welfare and support of Shana Smith's
dependents (if any);
3. That Shana Smith has been advised in writing by SABSCO, Transferee,
to seek independent legal advice regarding the transfer and has received said advice
or expressly and knowingly waived said advice in a separate written
acknowledgment;

5. That SABSCO has provided Shana Smith with a copy of the transferee's
application, with attachments, a copy of the notice and proposed order; and
6. That SABSCO has provided written notice of said Application to the
Annuity Issuer, the Structured Settlement Obligor, and other interested parties as
required by the Act, none of whom have submitted written objections to said transfer.
Based on the foregoing findings, it is hereby ORDERED, ADJUDGED, AND
DECREED that the transfer of the structured settlement payment rights, as described

I. I currently reside at 2205 Cedar Run Drive, Extended Apartment B,
Camphill, Pennsylvania 17011.
2. I am the recipient of certain guaranteed payments under a strUctured
settlement dated 24 August 1999. The entity presently obligated to
make payments due under the structured settlement is Symetra
Assigned Benefits Service Company. In order to fund its payment
obligations under the structured settlement, Symetra Assigned Benefits
Service Company purchased an annulI}' contract AA076637S from
Symetra Life Insurance Company.
3. I voluntarily entered into a Purchase & Sale Agreement (the
"Agreement") with Symetra Assigned Benefits Service Company
("SABSCO"). Under that Agreement, which is attached as Attachment
A, 1 agreed to sell and assign to Symetra Assigned Benefits Service
Company the following payments due to me under the structured
settlement;

accounts total less than two thousand dollars. I want to clear the
collection accounts up so that 1 qualify for a home loan. I intend to use
the proceeds 1 receive from Symetr;l Assigned Benefits Service
Company to payoff a few collection accounts and fund a down
payment on a home. I believe this is an efficient use of my money and
that I will be investing in my own future. Therefore, I have decided 10
pursue this transaction with SABSCO. After considering these factors
I believe that this transaction is in my best interest and in the best
interests of my dependents.
10. I will not be using any portion of the proceeds from the Agreement for
day-to-day expenses. I have never assigned, sold, or pledged any of the

Esquire, who, being du1y sworn according to law, deposes and says that he caused to be
mailed a copy of the Notice of Proposed Transfer of Structured Settlement Payment
Rights in the above-captioned matter by certified mail on May 3, 2006 to Shana Smith as
evidenced by certified mail receipt no. 7005 182000030004 1755 and that the Notice of
Proposed Transfer of Structured Settlement Payment Rights was received by Shana
Smith on May 8, 2006. Said certified mail receipts are attached hereto and made a part

Upon an application for Court Approval of a Transfer of Structured Settlement
Payment Rights ("Application") duly brought by Symetra Assigned Benefits Service
Company as Transferee ("SABSCO"), and the Court having considered documents in
support herein and written submissions, if any, filed by said interested parties named
below:

The Court, upon said i\pplication, hereby makes the following findings:
1. That the transfer sought to be approved complies with the requirements
of the Pennsylvania Structured Settlement Protection i\ct, P i\ St. 40 ~ 400 I, et seq.
(hereafter "the i\ct"), 26 D.S.C. ~ 5891, and does not contravene any applicable
statute or order of any court or other government or responsible administrative
authority;
2. That said transfer is in the best interest ofShana Smith,
Transferor/Payee, taking into account the welfare and support ofShana Smith's
dependents (if any);
3. That Shana Smith has been advised in writing by S.ABSCO, Transferee,
to seek independent legal advice regarding the transfer and has received said advice
or expressly and knowingly waived said advice in a separate written
acknowledgment;
4. That Si\BSCO has provided the Disclosure Statement as required by
the i\ct to Shana Smith;
5. That S.ABSCO has provided Shana Smith with a copy of the transferee's
application, with attachments, a copy of the notice and proposed order; and
6. That S.ABSCO has provided written notice of said i\pplication to the
J\nnuity Issuer, the Structured Settlement Obligor, and other interested parties as
required by the i\ct, none of whom have submitted written objections to said transfer.
Based on the foregoing fmdings, it is hereby ORDERED, i\DJUDGED, i\ND
DECREED that the transfer of the structured settlement payment rights, as described

in the "Purchase and Sale Agreement" filed with the Application herein, is hereby
approved and no party to this proceeding shall hereafter refuse to honor this approved
transfer.
It is FURTIIER ORDERED that, pursuant to the Act, by making and
delivering the Transferred Payments to SABSCO, as set forth herein, the Annuity
Issuer and the Structured Settlement Obligor will be discharged from all liability for
these Transferred Payments due the Transferor/Payee under the annuity.
Annuity Issuer and Structured Settlement Obligor are hereby ordered to remit
the following periodic payments, to wit: $25,000.00 lump sum payment due October
28,2006 and $57,66!.81 lump sum payment due October 28,2008 to:

SABSCO shall service the payment and remit $48,611.8lto Payee.
The Transferred Payments, as described in the "Purchase and Sale Agreement"
filed with the Application herein, shall be paid to SABSCO regardless of whether
Shana Smith is alive or deceased when the Transferred Payments become due.
This Order is entered without prejudice to the rights of Symetra Life Insurance
Company and/or Symetra Assigned Benefits Service Company and the Court makes no
finding regarding the enforceability of any non-assignment provisions contained in
the original settlement agreement or related documents. This Order in no way
modifies or negates the ownership or control of the underlying annuity contract by
Symetra Life Insurance Company and/or Symetra Assigned Benefits Service Company.
It is further ordered that the Structured Settlement Obligor and Annuity Issuer
shall irrevocably change the beneficiary for the Transferred Payments to SABSCO

and no other individual or entity other than SABSCO, its successors or assigns, shall
have the authority to change the beneficiary for the Transferred Payments.
Symetra Assigned Benefits Service Company and Symetra Life Insurance
Company shall provide formal acknowledgement of the terms of this transfer within
10 days of the date of receipt of this Order. The formal acknowledgement letter shall
be delivered to SABSCO at PO Box 34734, Seattle, Washington 98124.
This Order concludes the proceedings herein.
