Defendant is Junie Dominique Elysee, an adult individual whose last known address was 35-07 147`n Street, Flushing, Queens County, New York, 11354. 3. Plaintiff has been a bona fide resident of the Commonwealth of Pennsylvania for at least six (6) months immediately prior to the filing of this Complaint. 4. Plaintiff and Defendant were married on January 15, 1986 in New York.. 5. The marriage is irretrievably broken: Plaintiff and Defendant have lived separate and apart since January 15, 1986, and continue to live separate and apart as of the date of filing this Complaint. Plaintiff desires a divorce based upon the fact that the parties have been separated for a period of at least two (2) years. 6. There have been no prior actions of divorce or for annulment between the parties. 7. Defendant is not a member of the Armed Forces of the United States of America or any of its Allies. 8. The Plaintiff has been advised of the availability of counseling and the right to request that the Court require the parties to participate in counseling. Knowing this, the Plaintiff does not desire that the Court require the parties to participate in counseling. WHEREFORE, Plaintiff requests the Court to enter a decree of divorce. No. 430(a), Plaintiff, Gabbidon Larcher, by and through is counsel, Tanner Law Offices, LLC, respectfully moves this Court for a special order permitting service of the Divorce Complaint in this action by publication. In support of this motion, Plaintiff avers the following: 1. The last known address of Defendant, Junie Dominique Elysee (hereinafter referred to as the "Defendant"), is 35-07 147t" Street, Flushing, New York 11354. 2. On or about April 5`", 2006, Plaintiff filed a Divorce Complaint with the Cumberland County Prothonotary. 3. On or about April 11th, 2006, Plaintiff's counsel attempted to serve the Defendant by First Class U.S. Mail and Certified U.S. Mail, Restricted Delivery. However, the mail was returned to Plaintiff's counsel marked "unclaimed" and "attempted not known" (Exhibit A). 4. On or about April 26th, 2006, the U.S. Post Office notified Plaintiff's counsel that said Defendant's address was "unknown"(Exhibit B). 5. On or about June 2"d, 2006, Plaintiffs counsel requested the Defendant's address from the New York Board of Elections (Exhibit C). 6. On or about June 5th , 2006, the New York Board of Elections provided documentation, which indicated that "a Junia Elysee" had an address of 400 East 17 Street 202, Brooklyn, NY 11226 (Exhibit D). 7. While the name provided by the New York Board of Elections was slightly different than Defendant's, and realizing that spelling mistakes occur, on or about June 8th, 2006, Plaintiff's counsel attempted to serve the Defendant at 400 East 17 Street 202, Brooklyn, NY 11226. The complaint, however, was returned to the Plaintiff s counsel marked "unclaimed" and "unable to forward" (Exhibit E). 8. On or about August 23`d, 2006, Plaintiff's counsel attempted to serve a Subpoena to Produce Documents or Things for Discovery to the Department of Motor Vehicle in Albany, New York. Said subpoena requested the Defendant's address (Exhibit F). 9. On or about August 29t" , 2006, the New York Department of Motor Vehicles sent a letter to the Plaintiffs counsel stating that they could not honor the subpoena because it was issued by a court in another state (Exhibit G). 10. Unless the court allows service on the Defendant by publication, Plaintiff will be unable to maintain this action and injustice will result. WHEREFORE, Plaintiff respectfully requests that the Court enter a special order directing service ofthe Complaint on Defendant, Junie Dominique Elysee, by publication and that service of the Affidavit under Section 3301(d) of the Divorce Code and the Notice of Intention to Request Entry of Divorce Decree not be required. In support of this motion, Plaintiff avers the following: 1. Plaintiff and Defendant were married on January 15, 1986. 2. Prior to the date of marriage, Plaintiff and Defendant had known each other for a matter of days equaling less than one (1) week. 3. The parties have not seen or spoken or communicated with each other since approximately one (1) day after the marriage. 4& 4. The last known address of Defendant, Junie Dominique Elysee (hereinafter referred to as the "Defendant"), is 35-07 147" Street, Flushing, New York 11354. 5. On or about April 5, 2006, Plaintiff filed a Divorce Complaint with the Cumberland County Prothonotary. 6. On or about April 11, 2006, Plaintiff's counsel attempted to serve the Defendant by First Class U.S. Mail and Certified U.S. Mail, Restricted Delivery. However, the mail was returned to Plaintiff's counsel marked "unclaimed" and "attempted not known" (Exhibit A). 7. On or about April 26, 2006, the U.S. Postal Service notified Plaintiff's counsel that said Defendant's address was "unknown"(Exhibit B). 8. On or about June 2, 2006, Plaintiff's counsel requested the Defendant's address from the New York Board of Elections (Exhibit C). 9. On or about June 5, 2006, the New York Board of Elections provided documentation, which indicated that "a Junia Elysee" had an address of 400 East 17 Street 202, Brooklyn, NY 11226 (Exhibit D). 10. While the name provided by the New York Board of Elections was slightly different than Defendant's, and realizing that spelling mistakes occur, on or about June 8, 2006, Plaintiff's counsel attempted to serve the Defendant at 400 East 17 Street 202, Brooklyn, NY 11226. The complaint, however, was returned to the Plaintiff's counsel marked "unclaimed" and "unable to forward" (Exhibit E). . - 06 11. On or about August 23, 2006, Plaintiff's counsel attempted to serve a Subpoena to Produce Documents or Things for Discovery to the Department of Motor Vehicle in Albany, New York. Said subpoena requested the Defendant's address (Exhibit F). 12. On or about August 29, 2006, the New York Department of Motor Vehicles sent a letter to the Plaintiff's counsel stating that they could not honor the subpoena because it was issued by a court in another state (Exhibit G). 13. On or about October 4, 2006, Plaintiff's counsel performed a business search on a "Junie Elysee" via the Internet on Anywho.com. The search provided eight "matches". Plaintiff's counsel attempted to contact the eight matches via telephone and all eight indicated that they did not know of anyone by the name of Junie Elysee (Exhibit H). 14. On or about October 4, 2006, Plaintiffs counsel performed a background check on "Junie Elysee" via the Internet on Intelius.com. The background check provided several addresses in Massachusetts and one address (spelled two (2) ways) in New York (Exhibit 1). 15. Said Intelius report also listed an alias name of "Junie Jeancharles". 16. On or about October 4, 2006, Plaintiff's counsel contacted the Registry of Vital Records in Massachusetts and they confirmed that a Junie Elysee was married to a Robert Jeancharles in February 1992. 17. On or about October 4, 2006, Plaintiff's counsel performed a background check on "Junie Jeancharles" via the Internet on Zabasearch.com. The background check 4. r provided an address of 599 Lincoln Avenue, Saugus, MA (matching the information obtained through the Intelius.com background check on Junie Elysec) (Exhibit J). 18. On or about October 6, 2006, Plaintiff's counsel submitted four (4) Change of Address or Boxholder Request Format-Process Servers forms to the U. S. Post Office: One (1) for a "Junie Jeancharles" and one (1) for a "Junie Elysee", both residing at 599 Lincoln Avenue, Saugus, MA 01906 and at 1976 Bergen St. 2, Brooklyn, NY 11233 (Exhibits K-N). 19. On or about November 8, 2006, the U.S. Postal Service notified Plaintiff's counsel that said Defendant "moved, left no forwarding address" for "Junie Jeancharles" and "Junie Elysee" residing at 599 Lincoln Avenue, Saugus, MA 01906 (Exhibits O & P) 20. On or about November 20, 2006, the U.S. Postal Service notified Plaintiff's counsel that said Defendant's "address is vacant" for a "Junie Elysee" residing at 1976 Bergen St. 2, Brooklyn, NY 11233 (Exhibits Q). 21. On or about January 11, 2007, Plaintiff's counsel performed a search on Anywho.com via the Internet for a residential listing for a "Junie Elysee" and a "Junie Jeancharles" in New York and Massachusetts.
