TRIS AGREEMENT made
and between Fred A.
Corporation, hereinafter
ANP
Miehael A. Veliuona and TliUII~a L. HeiJnert, husband and wife,
hereinafter referred to as Owners, whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Hampden Township, CUmbe~land
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof and
known as LOt #36 Pelllngham Circle, 5037 Pellingham Circle,
Hampden Township, Cumberland County, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by OWner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic'S liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic'S liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL THAT CERTAIN piece or parcel ofland sitnate in the Township of Hampden,
County of Cum her land and Commonwealth of Pennsylvania, lying along Pellingham Circle
and heing approximately 750 feet northeast of the intersection of Good Hope Road and
Pellingham Circle, bounded and described as follows, to wit:
BEGINNING at the intersection of the easterly right-of-way line of Pellingham
Circle (50 feet wide) with the line of division between Lot 35 and Lot 36: extending (I)
thence North 260 26'00" East, a distance of 154.08 feet; extending (2) thence South
72031'47" East, a distance of 207.11 feet, extending (3) thence South 43037'21" West, a
distance of 217.27 feet to the easterly right-of-way line ofPellingham Circle: extending (4)
thence along said right-of-way line by a curve to the left having a radius of 475.00 feet, an
arc distance of 142.50 feet, and a chord bearing and distance of North 54058'20" West,
141.97 feet to the POINT OF BEGINNING.
BEING Lot No. 36 as shown on a plan entitled "Final Subdivision Plan for Phase II
and III, Wentworth Estates" dated 5/20104, last revised 8/17/04, Job Number 1001-846,
