HEIDECKER, 1139 Redwood Drive Carlisle, PA 17013 hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a SINGLE F AMIL Y DWELLING on that certain lot of ground situate in Lot 12 Bridgeport Drive Mechanicsburg, Silver Spring Township, PA 17055 Cumberland County, Pennsylvania. (SEE ATTACHED LEGAL DESCRIPTION) NOW THEREFORE, THIS AGREEMENT WITNESSTH: That the said Contractor. for and in consideration of the sum of ($1.00) Dollar to HARRY S. CLAYPOOL CONSTRUCTION in hand paid by Owner, the receipt whereof is hereby acknowledged, and further consideration mentioned in the agreement aforesaid, for themselves and their subcontraetors, and all parties acting through or under them, covenant and agree that no mechanics liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. -I Y- WITNESS our hands and seals this 2-) day of (YIil rc..h '7cU' . , ~ w Signed, Sealed and Delivered In the Presence of x/~b Title: President Name: IJarryS - Cla.ypuc/ Commission Expires: f':"')MMONWEALTH OF PENN!fVLVANIA ... -. Notary Public Sooth Middleton Twp Cumberland County Commission ~'pires Sel'tember 10. 2009 - ALL THAT CERTAIN tract or parcel of land situate in Silver Spring Township, Cumberland County, Pennsylvania, bounded and described as Lot 12 in accordance with the Major Final Subdivision Plan for The Peninsula (Phase III), prepared by Hartman and Associates, P.C. and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 70, at Page 63, more particularly bounded and described in Exhibit "A" attached hereto and made a part of hereof. BEING part of the premises which Sample Bridge Associates, a Pennsylvania general partnership, y its Deed dated December 23, 1997, and recorded December 24, 1997 in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book 169, Page 1034 granted and conveyed unto Sample Bridge, Inc., Grantor herein. UNDER AND SUBJECT to existing building restrictions, ordinances, easements of roads, privileges or rights of public service companies, if any; or easements or restrictions visible upon the ground, deed restrictions imposed on all Lots within Phase III of the Subdivision Plan, and easements and restrictions shown on the Subdivision Plan as recorded and the Declaration of Restrictions and Covenants as recorded in the Office of the Recorder of Deeds in and for Cumberland County on September 20,1995 in Misc. Book 504 at Page 41B. TOGETHER with all and singular the tenements, hereditaments and appurtenances to the same belonging, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof; AND ALSO all the estate, right, title, interest, property, claim and demand whatsoever, both in law and equity, of the Grantor, of, in, to or out of the said tract of land, and every part and parcel thereof TO HAVE AND TO HOLD the said tract of land, with all and singular the premises herein described together with the appurtenances, unto the Grantees, their heirs and assigns, to and for the only proper use and behoof of Grantees, their heirs and assigns forever.
