Contractor WHEREAS, Paramount Development, Inc. of Cumberland County, Pennsylvania (herein "Owner") is about to execute contemporaneously herewith, a contract, with Paramount Development, Inc. of Cumberland County, Pennsylvania (herein "Contractor"), for the construction work on a building upon Lot #12, Wentworth Estates, Cumberland County, Pennsylvania. more particularly set forth on Exhibit "A" attached hereto and made a part hereof. NOW, March 31, 2006, at the time of and immediately before the execution of the principal contract, and before any authority has been given by said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Owner and the further consideration of One ($1.00) Dollar in hand paid to Contractor by Owner it is agreed that no lien shall be filed against the building by the Contractor, or any sub-contractor, nor by any of the material-men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. " /' " ~/' r/o/' ,/< " I EXHIBIT "A" ALL THAT CERTAIN piece or parcel of land situate in the Township of Hampden, Count of Cumberland and State of Pennsylvania, lying along Eaglesmoor Lane and being approximately 1020 feet southwest of the intersection of Eaglesmoor Lane and Pellingham Circle, bounded and described as follows, to wit: BEGINNING at the intersection of the southerly right-of-way line of Eaglesmoor Lane (cul-de-sac) with the line of division between Lot 11 and Lot 12; extending (1) thence along Lot 11. South 030 26' 30" East, 195.78 feet; extending (2) thence along part of Lot 27 and Lot 28 of a plan entitled "Wellington of Hampden, Phase Two" as recorded among the land records of Cumberland County in Plan Book 57, Page 142, South 7r 27' 44" West, 562.82 feet, passing through an iron pipe found 203.16 feet from the beginning of said line, to an iron pin (found); extending (3) thence along the easterly line of lands now or formerly of McNaughton Homes, North 220 34' 41" West, 185.30 feet; extending (4) thence along Lot 13, North 690 27' 20" East, 565.01 feet to the southerly right-of- way line of Eaglesmoor Lane; extending (5) thence along said right-of-way line by a curve to the left, having a radius of 80.00 feet, an arc distance of 101.78 feet, and a chord bearing and distance of South 560 59' 35" East, 95.06 feet to the place of BEGINNING. SUBJECT to a twenty-five (25) feet wide easement for private land and utilities, the westerly line of which lies contiguous and parallel to the third (3) course and extending between and extending up or contracting to course (2) and course (4) of the previous description. SUBJECT to a thirty (30) feet wide utility and access easement, the centerline of said easement beginning at the intersection of the southerly right-of- way line of Eaglesmoor Lane and the common line between Lot 11 and 12, extending (1) thence along the common line between Lot 11 and 12, South 030 269300 East for a distance of 195.78 feet to a point on the southerly property line for the entire tract at lands now or formerly of Paul C. and Alison D. Coppock, the side lines of said easement to be prolonged or shortened to meet the aforementioned property line and right-of-way line. Said easement being 30 feet in width and lying 15 feet on each side of the above described centerline. SUBJECT to a thirty (30) feet wide utility and access easement, the southerly line of which lies contiguous and parallel to the second (2) course and extending between and extending up or contracting to course (1) and course (3) of the previous description. BEING Lot No. 12 as shown on a plan entitled "Final Subdivision Plan for Phase 1, Wentworth Estates" dated November 20, 2002, last revised April 11 ,2003, Job Number 1001-846, prepared by LSC Design, Inc., York, PA and recorded in Cumberland County office of the Recorder of Deeds in Plan Book 87 Page 50. BEING part of the same premises which became vested in Smith Land & Improvement Corporation by virtue of deed dated January 8,1997 and recorded January 9,1997 in Cumberland County Records, Deed Book 151, Page 871. ALSO BEING part of the same premises in which equitable interest become vested in Kinsley Equities II by virtue of Agreement recorded in Cumberland County Records, Misc.
