Shockey of 6375 Little Sorrel Drive, Mechanicsville, VA 23111, is about to execute contemporaneously herewith, a contract, with Haubert Homes Inc. of 15 Central Blvd., Camp Hill, PA 17011, for the erection of a building upon premises commonly known as Lot #53 Inverness Drive, Township Hampden, Cumberland County, Pennsylvania, as set forth in the deed dated 11/13/87, recorded at Book C-33, Page 304 (part of), in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, April 3, 2006, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Shockey' , Exhibit "A" ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the western right-of-way line of Inverness Drive, a 50 foot wide street, said point being the northwestern corner of Lot No. 52; thence along said right-of- way line along a curve to the right having a radius of 325.00 feet and an arc length of 104.96 feet, said arc being subtended by a chord of North 21 degrees 34 minutes 20 seconds East a distance of 104.50 feet to a point, said point being the western most corner of Lot No. 54; thence along the southern line of said lot South 50 degrees 10 minutes 35 seconds East a distance of 105.00 feet to a point, said point being the northern most corner of Lot No. 51; thence along the western line of said lot South 21 degrees 33 minutes IS seconds West a distance of70.73 feet to a point, said point being the northeastern corner of Lot No. 52; thence along the northern line of said lot North 77 degrees 40 minutes 46 seconds West a distance of 105.02 feet to a point, the PLACE OF BEGINNING.
