Contractor STIPULATION AGAINST LIENS WHEREAS, CUMBERLAND MEDICAL PROPERTIES, LLC, Owner, is about to execute contemporaneously herewith a contract with GALBRAITH/PRE-DESIGN, INC., Contractor, for the execution of a single story 10,250 square foot professional office building shell situate on Lot #17 in the McCoy Business Park, South Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and described on the attached Exhibit "A". NOW, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same, in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to be paid to Contractor, it is agreed that no lien shall be filed against the building by the Contractor, or any Subcontractor, nor by any of the materialmen or workmen or any person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. ,IIi:> WITNESS our hands and seals the r- day of April, 2006. Longton, LEGAL DESCRIPTION ALL THAT CERTAIN tract of land situate in South Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNNG at a point on the northern right of way line of Alexander Spring Road (township road number T-469), said point being the Southwest corner of Lot No. 18; thence along the right of way line of Alexander Spring Road (said right of way line being measured 25 feet from and parallel with the centerline of Alexander Spring Road) South 76 degrees 14 minutes 17 seconds West, a distance of 224.95 feet to a point; thence leaving said Alexander Spring Road by a curve to the right along Commerce Avenue (township road number T-410), said curve having a radius of 25.00 feet, an arc length of 39.32 feet (said arc having a chord of North 58 degrees 42 minutes 08 seconds West, 35.39 feet) to a point, on right of way line of Commerce Avenue, said point being 25.00 feet East of the centerline of Commerce Avenue; thence along said Commerce Avenue, North 13 degrees 38 minutes 34 seconds West, a distance of 225.00 feet to a point at Lot No. 16; thence along Lot No. 16, North 75 degrees 21 minutes 26 seconds East, a distance of 250.00 feet to a point at Lot No. 18; thence along Lot No. 18, South 13 degrees 38 minutes 34 seconds East, a distance of 249.53 feet to a point on the northern right of way line of Alexander Spring Road at the place of BEGINNING. CONTAINING 1.43 acres. BEING LOT No. 17 as shown on the Final Minor Subdivision Plan (Lots 10-18) as recorded in the office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 61, Page 121.
