BELINSKA.S, as their interests may appear, Fee Simple Owner V. JOY-ARK BUILDER, INC, STIPULATION AGAINST LIENS WHEREAS, RICHARD R. BELINSKAS and DEBORAH A. BELINSKAS, (the "Owners"), have executed or are about to execute contemporaneously herewith a contract with JOY-ARK BUILDERS, INC. (the "Contractor"), for construction work (collectively the "Improvements") on a tract ofland located in RIDGE ESTATES, situate in the Township of MIDDLESEX, County of Cumberland, Pennsylvania, kno"'TI as Lot No.7, Plan Book 91, Page 8, and more particularly described in Exhibit A attached hereto, incorporated herein by reference and made a part hereof (the "Premises"). NOW, April 4, 2006, before any authority has been given by the Owner to the Contractor to commence work on the Improvements, or to purchase ma1erials for the same, or to enter into any contracts with any subcontractors or material men, or 10 authorize any purchases by or through any subcontractors or material men, in consideration of the making of said contract with the Owner and 1he further consideration of One ($1.00) Dollar, to Contractor paid by Owner, and with the intent of all parties to be legally bound hereby, i1 is a!,'feed that no lien shall be filed against the Improvements, the Premises, or any part thereof, by the Contractor or any subcontractor, or by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased, for the Improvements to the Premises (including hereafter changes made thereto), the right to file liens being expressly waived. It is the full intent of the Contractor, for himself and for any subcontractors or material men claiming for themselves, or by, through or under the contract or the Contractor, that the right to file a mechanic's lien, under the provisions oflaw and/or of Acts of Assembly in such cases made and provided, for work done or materials furnished in ad about the construction of the Improvements to the Premises is hereby waived. ALL THAT CERTAIN lot or parcel of land situate in MIDDLESEX TOWNSHIP, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a point in Ridge Drive (T-571), at a common property corner of Lot No.1 and Lot No.7 of the Final Subdivision Plan for Ridge Estates; thence through said Ridge Drive (T -571) and along said Lot No.1, North 8 degrees 30' 00" West, a distance of 417.22 feet to a point at a common property corner of Lot No.1, Lot No.2 and Lot No.7; thence along a portion of said Lot No.2 and a portion of Lot No.5, North 81 degrees 30' 00" East, a distance of 225.00 feet to a point at a common property corner of Lot NO.5 and Lot No.7; thence along said Lot No.5, South 8 degrees 30' 00" East, a distance of412.62 feet to a point in Ridge Drive (T-571); thence through said Ridge Drive (T -571), South 80 degrees 19' 39" West, a distance of 225.04 feet to a point, said point being the point of BEGINNING.
