Ol.., - ~633 fr2i:b~~ STIPULATION AGAINST LIENS WHEREAS, STEPHEN C. NUDEL and GINA G. NUDEL, of 3 Westwind Drive, Lemoyne, Pennsylvania 17043 (the "Owner") the Owner of the hereinafter described tract of land, has executed or is about to execute contemporaneously herewith a contract with JEFFREY S. COLEMAN of 4620 North Road, Harrisburg, Pennsylvania 17109 (the "Contractor") for improvements to the premises located at 3 Westwind Drive, Lemoyne, Cumberland County, Pennsylvania 17043 (the "Premises"). NOW, April 1, 2006, before any authority has been given by said Owner to the said Contractor to commence work on said Premises or to otherwise construct any improvements thereto, or to purchase materials for the same, or to enter into any contracts with any subcontractors, or materialmen, or to authorize any purchases by or through any subcontractors or materialmen, in consideration of the making of said contract with the Owner and the further consideration of One Dollar ($1.00), to Contractor paid by said Owner, and with the intent of all parties to be legally bound hereby, it is agreed that no lien shall be filed against the building or Premises or any part thereof, by the Contractor or any subcontractor, or by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased, for the t , building and improvements to the Premises (including hereafter changes made thereto), the right to file liens being expressly waived. It is the full intent of the Contractor, for itself and for any subcontractors or materialmen claiming for themselves, or by, through or under the contract or the Contractor, that the right to file a mechanic's lien, under the provisions of law and/or of Acts of Assembly in such cases made and provided, for work done or materials furnished in and about the building and improvements to the Premises above described is hereby waived. I t EXHIBIT A ALL THAT CERTAIN tract or parcel of ground situate in the Borough of Lemoyne, Cumberland County, Pennsylvania, known and numbered as Lot No. 29 on a Plan of Lots known as "White Oaks", as prepared by Robert G. Hartman, Jr., Registered Surveyor, and recorded in the Office of the Recorder of Deeds in and for Cumberland County in Plan Book 58, Page 26, which lot is more particularly bounded and described as follows, to wit: BEGINNING at the point on the southeast corner of the property, said point intersecting the right-of-way of Westwind Drive and being the dividing line of Lot. No. 29 and Lot No. 30 on the hereinbefore mentioned Plan of Lots; thence along said dividing line, South 47 degrees 27.30 minutes West, a distance of 188.42 feet to a point intersecting property now or formerly owned by Susquehanna Enterprises, Inc.; thence along dividing line of Lot No. 29 and the land now or formerly of Susquehanna Enterprises, Inc., North 36 degrees 22.27 minutes West, a distance of 196.14 feet to a point, said point being the dividing line between Lot No. 28 and Lot No. 29 on the hereinbefore mentioned Plan of Lots, thence along said dividing line, North 47 degrees 27.30 minutes East, a distance of 167.35 feet to a point intersecting a right-of-way known as Westwind Drive; thence along the right- of-way line between Lot No. 29 and Westwind Drive, South 42 degrees 32.30 minutes East, a distance of 195.00 feet to a point, the place of BEGINNING. CONTAINING .7963 acres, more or less. HAVING THEREON ERECTED a dwelling known as 3 Westwind Drive. UNDER AND SUBJECT to restrictions of record as found on the Plan of Lots of White Oaks and further subject to a 15 foot drainage easement running along the western boundary of the property, as well as other restrictions of record. BEING the same premises which Frank R. Lonley, Jr., and Mary L. Lonley, husband and wife, by their deed dated July 16, 2003, recorded July 23, 2003, and recorded in Cumberland County Deed Book 258, Page 1314, granted and conveyed upon Stephen C. Nudel and Gina G.
