RICKERT, CIVIL DIVISION - LAW Defendant COMPLAINT The Plaintiff, FIRST NATIONAL BANK OF OMAHA, by its attorneys, KNUPP, KODAK & 1M BLUM, P .C., brings this action of Assumpsit against the Defendant to recover the sum of FOUR THOUSAND ONE HUNDRED SIXTY THREE DOLLARS AND FIFTEEN CENTS ($4,163.15), along with interest thereon at the rate of 6.0% from March 21, 2006, upon a cause of action of which the following is a statement: 1. The Plaintiff, FIRST NATIONAL BANK OF OMAHA, is a National Banking Association organized and existing under the laws of the state of Nebraska, having mailing address of Post Office Box 2951, Omaha, Nebraska, 68103-2951. 2. The Defendant, RANDALL M. RICKERT, is an adult individual residing at 410 North Walnut Street Rear, Mt. Holly Springs, Cumberland County, Pennsylvania 17065. 3. On or about May 11, 2003, Defendant did apply for a Visa Account with Plaintiff. Subsequent thereto Plaintiff issued same to Defendant to account number ending 5515. Upon receipt and use of said card, Defendant did agree to abide by Plaintiff's tenns and conditions for the card as set forth on Plaintiff's Cardmember Agreement, attached hereto, marked Exhibit "A" and made a part hereof. Defendant did, at various times, in various places, and for various amounts, avail himself of using the card for credit, thereby creating a balance due and owing in the amount of Three Thousand Four Hundred Sixty-Nine Dollars and Twenty-Nine Cents ($3,469.29), as set forth on Plaintiff's Invoice attached hereto, marked as Exhibit "B" and made a part hereof. 5. The prices charged for said goods, wares, merchandise, services, and/or labor which Defendant charged on said card were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant promised and agreed to pay. 6. Due to the default of Defendant, and pursuant to the terms and conditions of the Credit Application executed by Defendant hereto attached, marked Exhibit "A" and made a part hereof, attorney's fees in the total amount of Six Hundred Ninety Three Dollars and Eighty Six Cents ($693.86) have been added to said account. 7. Plaintiff frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant refused and neglected and still refuses and neglects to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of FOUR THOUSAND ONE HUNDRED SIXTY THREE DOLLARS AND FIFTEEN CENTS ($4,163.15), along with interest thereon at the rate of 6.0% from March 21, 2006.
