No other persons are known to have or claim to have any right to custody or visitation of the child other than the parties to this action. 12. The best interest and permanent welfare of the child will be served by granting the relief requested because the Plaintiff is the primary care giver with respect to the child. Hayden C. Bevins, born October 9, 2005 is the natural child of Shayla Zalewski and Jon Bevins. 2. The Father, Jon Bevins, and the Mother, Shayla Zalewski, shall enjoy shared legal custody of Hayden C. Bevins, born October 9, 2005. Major decisions concerning their child, including, but not necessarily limited to, the child's health, welfare, education, religious training and upbringing shall be made by them jointly, after discussion and consultation with each other, with a view toward obtaining and following a harmonious policy in the children's best interest. Each party shall not impair the other party's rights to shared legal custody of the child. Each party shall not alienate the affections for the child from the other party. Each party shall notify the other of any activity or circumstance concerning their child that could reasonably be expected to be of concern to the parent then having physical custody. With regard to any emergency decisions that must be made, the parent having physical custody of the child at the time of the emergency shall be permitted to make any immediate decisions necessitated thereby. However, that parent shall inform the other of the emergency and consult with him or her as soon as thereafter possible. Each party shall be entitled to complete and full information from any doctor, dentist, teacher, professional or authority and to have copies of any reports given to either party as a parent. 3. Sunday May, 21, 2006: Mom shall have custody of the child until Tuesday, May 23, 2006 at 12:00 noon d. May 23, 2006: Dad shall have the child from 12:00 noon until Thursday, May 25, 2006 at 12:00 noon. 4. The above fourteen-day schedule will be repeated unless otherwise agreed upon by the parties. a. The cycle shall continue to repeat itself every 14 days throughout the calendar year. 5. Exchange of custody shall occur by the non-custodial parent securing custody of the child at the residence of the custodial parent unless the parties agree otherwise. 6. The Holidays custodial periods of the child shall be as outlined below: Memorial Day, 2006 - Mother shall have custody of the child from 8:00 a.m. to 8:00 p.m. July 4, 2006 - Mother shall have custody of child from 8:00 a.m. to 12:00 p.m. (noon); Father shall have custody of the child from 12:00 p.m. (noon) until 4:00 p.m. Labor Day, 2006 - Father shall have custody of the child from 8:00 a.m. to 8:00 p.m. Thanksgiving, 2006 - Mother shall have custody of the child from 8:00 a.m. to 2:00 p.m.; Father shall have custody of the child from 2:00 p.m. until 8:00 p.m. Christmas Eve/Christmas, 2006 - Mother shall have custody of the child from Christmas Eve at 8:00 a.m. until Christmas Day at 12:00 p.m. (noon); Father shall have custody of the child from 12:00 p.m. (noon) until 12:00 p.m. (noon) the day after Christmas. New Year's Eve/New Year's Day 2006 to 2007 - Father shall have custody of the child from New Year's Eve at 12:00 p.m. (noon) until New Year's Day at 12:00 p.m. (noon); Mother shall have custody of the child from New Year's Day at 12:00 p.m. (noon) until the 12:00 p.m. (noon) the day after New Year's Day. Martin Luther King Day, 2007 - Mother shall have custody of the child from 8:00 a.m. until 8:00 p.m. President's Day, 2007 - Father shall have custody of the child from 8:00 a.m. until 8:00 p.m. Easter, 2007 - Mother shall have custody of the child from 8:00 a.m. until 2:00 p.m.; Father shall have custody of the child from 2:00 p.m. until 8:00 p.m. The above Holiday schedule shall alternate and rotate each year unless agreed upon otherwise by the parties. Mother's Day - Mother shall always have custody of the child for the entire day. Father's Day - Father shall always have custody of the child for the entire day. 7. Birthdays November 23: Mother's birthday, except when November 23 occurs on Thanksgiving, when the above outline shall govern, mother shall have custody of the child from 8:00 a.m. to 8:00 p.m. February 15: Father's birthday, Father shall have custody of the child from 8:00 a.m. until 8:00 p.m. October 9: Hayden's birthday, Mother shall have custody of the child from 8:00 a.m. until 2:00 p.m.; Father shall have custody from 2:00 p.m. until 8:00 p.m.' 8. Vacation: Each party shall have 2 weeks (consecutive or non-consecutive) vacation each year with the child. Thirty days written notice shall be provided to the other parent detailing the destination, emergency telephone numbers, and the identities of the child's traveling companions. 9. No alcoholic or illicit drugs shall be used by the custodial parent when the child is in their custody; likewise, the custodial parent shall not be under the influence of alcohol or illicit drugs while the child is in his/her custody. 10. Neither parent shall make nor permit disparaging remarks to be made about the other parent within "ear shot" of the child. 11. The parties may alter this schedule as they may agree. However, if the parties cannot agree, the schedule outlined in this order shall control. 12. Both parents shall have liberal and reasonable telephone contact with the child when the child is in the custody of the other parent. 13. The custodial parent shall inform the non-custodial parent immediately of all medical appointments and problems pertaining to the child. 14. In the event either party wishes to modify this Stipulation/Order, they may petition to have the case scheduled with the Court.
