A Judgment for rent, costs and to force eviction was entered against the Rosemarines on March 30, 2006, by Susan Day, Magistrate District No.09-03-3, whereby the Rosemarines were ordered to pay $226.75 as rent and costs due through April 11, 2006, and to vacate the premises within 10 days. A copy of this Judgment is attached. 2. Cause for this action was: a. the failure of the Rosemarines to vacate at the end of their lease despite written promises to do so b. the unwillingness of the Plaintiff to renew the lease because of the Rosemarine's history of harassment of other tenants and inconsistency in payment of rent. (Support of the incidents of harassment is available by testimony of other tenants and by a police report from Trooper Jeremy Maras of the Pennsylvania State Police, who responded to complaints from other tenants.) c. the Rosemarines failure to pay rent due for the period beyond the expiration of the lease even though they had refused to vacate. 1 3. On April 21, 2006, Plaintiff sent a letter to the Rosemarines informing them that the apartment building had been sold. In that letter Plaintiff offered to allow the new landlord to determine whether or not he would be willing to accept the Rosemarines on a month- to-month basis, provided certain conditions as outlined in the letter was met. A copy of that letter is attached 4. As of today, April 28, 2006, the Rosemarines have neither vacated nor paid the judgment. 5. By telephone on Thursday April 27, Barry Rosemarine informed Plaintiff that: a. he was not going to meet with the new landlord as stated in the letter of April 21 b. he was not going to further pursue his appeal of the Judgement of April 11 c. he would shortly be vacating the premises "to move back east" d. he was sending Plaintiff the funds due as stated in Plaintiff's letter of April 21. e. he had written Plaintiff a letter, which Plaintiff received April 27, 2006, putting this in writing. A copy of that letter is attached. 6. Plaintiff therefore pleads that the original Judgment should be upheld, and that the Rosemarines should further be ordered to pay the balance due for rent through the month of April, 2006, and to pay the rent due for May, 2006. 7. The total amount due is as follows: Rent Balance Due for April 12-30, 2006: $ 357.50 Previous balance due per Judgment 226.75 Rent for May, 2006 560.00 TOTAL AMOUNT DUE PLAINTIFF $ 1,144.25 8. The Rosemarines have stated in writing as attached, that these funds are currently IN ESCROW with the Court of Common Pleas. Plaintiff therefore requests The Court of Common Pleas to set aside the appeal of Judgment entered by the Rosemarines and release to Plaintiff the escrowed rents & costs. The buyer may have already contacted you regarding this. Subject to certain conditions, he has indicated a willingness to allow you to remain. These conditions are: 1. I provide proof that you have maintained your rental payments and other costs current through settlement (now scheduled to mid-May) 2. The new owner interviews you and is satisfied with having you as a tenant. In order for me to provide the proof that you have maintained your rental payments, I need the following from you: 1. Rent for May 2006 by May 55i as per our agreement $ 560.00 If you satisfy these requirements, I will be able to satisfy your new landlord's criteria, and at settlement: 1. I have initiated this effort to provide you some relief as you look for another place. Nothing that has transpired between you and me other than your rental history will be communicated to the Buyer. You will have the opportunity for a fresh start with him if you too will refrain from further acrimony and make the payments reflected above. If you choose not to take advantage of this offer, I will continue on my previous course seeking your eviction.
