GLAZIER, Defendant IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. IN DIVORCE COMPLAINT AND NOW, comes Plaintiff, David , by and through his attorneys, Rupp and Meikle and Richard C. Rupp, Esq., and files this Complaint in Divorce, based upon the following: 1. Plaintiff, David C. Glazier, is an adult individual residing at 2101 Douglas Drive, Carlisle, PA 17013, Cumberland County, who has resided in Cumberland County for over five years. 2. Defendant, Nicole L. Glazier, is an adult individual residing at 1359 Zimmerman Road, Boiling Springs, PA 17007, Cumberland County. 3. Plaintiff and Defendant have been bona fide residents in the Commonwealth of Pennsylvania for at least five (5) years previous to the filing of this Complaint. 4. Plaintiff and Defendant were married on October 10, 2003 5. There have been no prior actions for divorce or annulment between the Parties except this Complaint filed for divorce. 6. The marriage is irretrievably broken. 7. Plaintiff, having been advised of the availability of marriage counseling and of the right to request the Court require the parties participate in marriage counseling, waves this right. 8. Plaintiff is not a member of the Armed Services of the United States of America and Defendant is not a member of the Armed Services of the United States of America. 9. Plaintiff and Defendant have one (1) child from their marriage: Terrance D. Glazier, age 2 years. COUNT I - REQUEST FOR NO FAULT DIVORCE UNDER SECTION 3301(c) OF THE PENNSYLVANIA DIVORCE CODE 10. Paragraphs 1 though 9 of this Complaint are incorporated herein by reference thereto. 11. After 90 days elapses from the date of filing this Complaint, Plaintiff intends to file an Affidavit consenting to the divorce. Plaintiff believes Defendant will also file such an Affidavit of Consent. WHEREFORE, if both parties file Affidavits consenting to a divorce after 90 days have elapsed from the date of filing of this Divorce Complaint, Plaintiff David C. Glazier respectfully requests this Honorable Court to enter a Decree of Divorce pursuant to Section 3301( c ) of the Pennsylvania Divorce Code. COUNT II - REQUEST FOR FAULT DIVORCE UNDER SECTION 3301 (a)(6) OF THE PENNSYLVANIA DIVORCE CODE 12. Paragraphs 1 though 11 of this Complaint are incorporated herein by reference thereto. 13. A. In the alternative, the Defendant has offered and caused such indignities to the person of the Plaintiff, the injured and innocent spouse, as to render his condition intolerable and his life burdensome by reason of the causes, actions and conditions caused by Defendant to the Plaintiff under 23 Pa. C.S.A. 3301 (a)(6), and/or B. The Defendant has committed adultery during the marriage. WHEREFORE, the Plaintiff respectfully requests this Honorable Court to enter a Decree in Divorce dissolving the bonds of matrimony under the grounds of a fault divorce in accordance with 23 Pa. C.S.A 3301 (a) (6) COUNT III - REQUEST FOR EQUITABLE DISTRIBUTION OF MARITAL PROPERTY UNDER SECTION 3502 OF THE PENNSYLVANIA DIVORCE CODE 14. Paragraphs 1 through 13 of this Complaint are incorporated herein by reference thereto. 15. The Plaintiff respectfully requests this Honorable Court to equitably divide, distribute or assign the marital property between the parties, in such proportion as the Court deems just after consideration of all relevant factors, in accordance with the provisions of the Pennsylvania Divorce Code, 23 Pa. C.S.A. 3502. WHEREFORE, Plaintiff David C. Glazier respectfully requests this Honorable Court to enter an Order of equitable distribution of marital property pursuant to Section 3502 of the Pennsylvania Divorce Code.
