Plaintiff is Eugene M. Chabak, an adult individual who resides at 608 E, Winding Hill Road, Mechanicsburg, Cumberland County, Pennsylvania. 2. Defendant is Wendy 1. Chabak, an adult individual who resides at IS E. Glenwood Drive, Camp Hill, Cumberland County, Pennsylvania. 3, Plaintiff seeks custody of his children Kyle M. Chabak, born May 2,1997, and Haylee R, Chabak, born June 1,2004, 4. The children presently reside with Defendant at IS E. Glenwood Drive, Camp Hill, Pennsylvania. 5. Since the children's birth, they have resided with the following persons over the past five years: Name Address Date Eugene Chabak & Wendy Chabak 68 W. The natural mother of the child is Wendy Chabak, currently residing at the above stated address. 7. The natural father ofthe child is Eugene Chabak, currently residing at the above stated address. 8. The relationship of the Plaintiff to the child is that of natural father. 9. The relationship of the Defendant to the child is that of natural mother. 10. The Plaintiff has not participated as a party or in any other capacity, in other litigation concerning the custody ofthe children in this or any other court. 11, Plaintiff has no information of a custody proceeding concerning the children pending in a court of this Commonwealth. 12, The best interests and permanent welfare of the child will be served by granting the relief requested because the Plaintiff is natural father of the child and can best care for the children. 13. Plaintiff is being denied custody as well as communication with the children. 14. Defendant continually disparages Plaintiff in front of the children. 15. Each parent whose parental rights to the child have not been terminated and the person who has physical custody of the children have been named as parties to this action. No other persons are known to have or claim to have any right to custody or visitation of the child other than the parties to this action. WHEREFORE, Plaintiff requests your Honorable Court to enter a custody order which grants Plaintiff full physical and legal custody, in the alternative, to grant Plaintiff equally shared custody.
