NATIONWIDE INSURANCE 1 Nationwide Plaza Columbus, OH 43215-2220 Defendant : ARBITRATION COMPLAINT AND NOW, comes the Plaintiff, Erie Insurance Group a/s/o Asher Zeitlen, by and through its attorneys, Johnson, Duffie, Stewart & Weidner, P.C., and files the following Complaint, and in support thereof avers as follows: 1. The Plaintiff, Erie Insurance Group, a/s/o Asher Zeitlen, is a Pennsylvania insurance company with its principal place of business located at 4901 Louise Drive, Rossmoyne Business Center, P.O. Box 2013, Mechanicsburg, Pennsylvania 17055. 2. The Defendant, Nationwide Insurance, is an Ohio insurance company with its principal place of business located at 1 Nationwide Plaza, Columbus, OH 43215-2220. 3. At all times relevant hereto, Erie was the insurer of Asher Zeitlen's home, located at 148 Walnut Street, Lemoyne, Pennsylvania 17043. 4. To the extent that Erie has paid certain sums of money to Asher Zeitlen pursuant to an insurance policy, Erie is a subrogee of Asher Zeitlen with respect to the claims made against Nationwide Insurance. 5. On or about July 23, 2004, Asher Zeitlen's home sustained property damage when a dead tree fell on Zeitlen's home during a severe storm. 6. At all times material hereto, Defendant was the insurer of the property owner from which the dead tree fell. 7. By reason of the aforesaid property damage sustained, the Plaintiff, Erie Insurance Group, by reason of a policy of insurance maintained by Zeitlen, was forced to pay for the property damage sustained, and therefore presents this claim in subrogation. 8. At all times material hereto, Erie Insurance and Nationwide Insurance are members of the Arbitration Forums, Inc. A copy of the Property Subrogation Arbitration Agreement is attached hereto and incorporated herein by reference as Exhibit "A." 9. On or about July 7, 2005, an arbitration hearing was held and Plaintiff was awarded $5,670 as a result of the arbitrary decision. A copy of the arbitration award is attached hereto and incorporated herein by reference as Exhibit "B." 10. In compliance with Section Six, Rule 6-1 of the Property Subrogation Arbitration, all awards shall be paid within thirty (30) days of publication. A copy of Section Six is attached hereto and incorporated herein by reference as Exhibit "C." 11. In compliance with Section Six, Rule 6-2 of the Property Subrogation Arbitration, Plaintiff and the Arbitration Forums, Inc., notified Defendant in writing that payment has not yet been made. A copy of Arbitration Forums, Inc.'s December 19, 2005 letter to Nationwide is attached hereto and incorporation herein by reference as Exhibit "D." 12. Defendant refuses and continues to refuse to make payment awarded to Plaintiff in the amount of $5,670. This refusal is in violation of the Arbitration Agreement and done in bad faith. 13. Plaintiff is entitled to recover attorneys' fee and costs incurred. 14. Plaintiff avers that damages do not exceed the applicable limits of arbitration referral by Local Rule. WHEREFORE, the Plaintiff demands judgment against the Defendant, Nationwide Insurance, in the amount of $5,670.00, together with attorneys' fees, interest and costs of suit. By signing this Agreement, the company accepts and binds itself to the following: Article First Compulsory Provisions Signatory companies must forego litigation and submit any personal, commercial, or self-insured property subrogation claims to Arbitration Forums, Inc. (herein after referred to as AF). Article Second Exclusions No company shall be required, without its written consent, to arbitrate any claim or suit if: Article Third Decisions The decision of the arbitrator(s): (a) shall be based on local jurisdictional law consistent with accepted claim practices. (b) is final and binding without the right of rehearing or appeal. However, this does not preclude AF from correcting a clerical or jurisdictional error of an arbitrator(s) or AF staff. (c) is neither res judicata nor collateral estoppel to any other claim or suit arising out of the same accident, occurrence, or event except where an applicant seeks recovery of supplemental damages as allowed under the Awards section of the rules. The decision is conclusive only of the issues in the matter submitted to the panel and only as to the parties to the arbitration. The admissibility of the decision in any other proceeding is not intended, nor should be inferred from this Agreement. All matters concerning an arbitration proceeding shall be held in strict confidence. Article Fourth Non-Compulsory Provisions The parties may, with written consent, submit a claim: (a) that exceeds this forum's monetary limit, or (b) where a non-signatory wants to participate. Once a company gives written consent, all Articles and Rules of this forum are applicable, and the company may not revoke its consent. ~.Rll]TR^nON fORUMS. INl:. Any signatory company may withdraw from this Agreement by notice in writing to AF. Such withdrawal will become effective sixty (60) days after receipt of such notice except as to cases then pending before arbitration panels. The effective date of withdrawal as to such pending cases shall be upon final compliance with the finding of the arbitration panel on those cases. If the award remains unpaid thirty (30) days after written request for payment, the Applicant company should send a copy of the letter to AF for processing. 5-5 After rendering a decision, arbitrators shall complete the following on the AF application (P-Form): (a) date closed (b) arbitrator's name (written legibly) (c) basis of findings (d) denote appearance of Applicant and Respondent in space provided (e) amount claimed (I) awards, if any 5-6 AF will send the decision to all interested parties by First Class Mail or electronic data interchange system. SECTION SIX AWARDS 6-1 Respondent(s) shall pay all awards within thirty (30) days of publication. 6-2 When an Applicant receives an award and Respondent does not honor it within thirty (30) days of publication, the local representative must immediately send a written request for payment. The Applicant should address the request to the Respondent's local senior claim representative by name. AF will bring the matter to the attention of the highest level within the Respondent company. Thirty (30) days after AF responds to the matter, the Applicant company is free to file in litigation for collection.
