Barbara McK. Mumma and Lisa M. Morgan, Executrices of the Estate of Robert M. Mumma,
deceased, and Ttustees under his Will, by their attorneys, MARTSON DEARDORFF WILLIAMS &
OTTO, hereby move this court to strike Robert M. Mumma, II's Lis Pendens notice, and in support
thereof state the following:
1. On January 6, 1999, Robert M. Mumma, II, petitioned this court for an accounting of the
estate of his father, Robert M. Mumma, Sr.
2. On February 14,2006, RobertM. Mumma, I1,prose, filed a "Praecipe to Attach Deed
and Index As Lis Pendens" to the above captioned docket number.
3. A review of the Deed which Robert M. Mumma, n, attached to his Lis Pendens notice is
a Deed for certain real property located in Silver Spring Township, Cumberland County, Pennsylvania,
which was conveyed by the three Liquidating Trustees of a partnership known as Highspire Sand and
Gravel Company, Limited-ofwhomMr. Mumma, Sr. was a Trustee-and Mr. Mumma, Sr. and Dauphin
Deposit Trust Company, as executors of the estate of Walter M. Mumma. The property was transferred
to Pennsy Supply, Inc.
4. Consequently, the property in question was not, at the time of the transferreflected in the
deed, owned by Mr. Mumma, Sr. individually, nor does Mr. Mumma, II, in the Praecipe or any
documentation attached to it suggest that Mr. Mumma, Sr. even came into possession of the property.
Similarly, nothing in the Praecipe suggests that Mr. Mumma, Sr. owned the property in question at the time
of his death, or that Mrs. Mumma and Mrs. Morgan ever administered it in their capacities as executrices
and trustees.
5. Pennsylvania law dictates that a lis pendens may only be indexed when title to the real
estate itself is involved in a suit. US. Bank in Johnstown v. Johnson, 506 Pa. 622,487 A.2d 809
(1985).

6. The doctrine of lis pendens is appropriately invoked only when a specific property is the
subject matter of the suit before the court. Archibaldv. General Construction Associates, Inc., 7 Pa.
D&C.3d 427,436 (C.C.P. Bucks 1978).
7. The property referenced in the Deed attached to Robert M. Mumma, IT's lis pendens bears
absolutely no relationship to the issues involved in this litigation.
8. As a consequence, the filing of the lis pendens was inappropriate and without justification.
9. Robert M. Mumma, II has filed identical "Praecipe to Attach Deed and Index as Lis
Pendens" for the same property in at least three other matters. I A copy ofthe same deed was attached
to each ofthe Praecipes. True and accurate copies of those Praecipes are attached hereto as "Exhibits
A - C" and are incorporated herein by reference.
1 O. In each of those cases, the defendants sought to strike off the lis pendens on the grounds
that the property referenced in the Deed bore absolutely no relationship to the issues in that action. True
and accurate copies of those Motions to Strike are attached hereto as "Exhibits D-F" and are
incorporated herein by reference.
11. In each ofthose cases, the Honorable J. WesleyOler,Jr., struck Robert M. Mumma, IT's
Lis Pendens notice by Order of Court. True and accurate copies of said orders are attached hereto as
"Exhibits G-I" and are incorporated herein by reference.
12. The filing of a lis pendens against property that has nothing to do with the subject matter
of the present action constitutes an abuse of process for which sanctions in the form of counsel fees and
costs should be imposed against Robert M. Mumma, II.
WHEREFORE, Barbara McK. Mumma and Lisa M. Morgan, Executrices of the Estate of Robert
M. Mumma, deceased, and Trustees under his Will, respectfully request that this Court Strike Plaintiff s
Praecipe to Attach Deed and Index as Lis Pendens, impose sanctions against Robert M. Mumma, II, for

DEFENDANT'S MOTION TO STRIKE LIS PENDENS
AND NOW, comes Defendant Pennsy Supply, Inc. ("Pennsy"), by and through its
counsel, Saul Ewing LLP, and files its Motion to Strike Lis Pendens, and in support thereof states
the following:
1. Plaintiff, Robert M. Mumma, II ("Mumma"), initiated this action by filing
a Complaint with this Court on May 7, 1999.
2. In his Complaint, Mumma sought a declaration that he retained an
ownership interest in a corporation known as Pennsy Supply Inc. (with no comma), which,
according to Mumma, "ha[d] survived for over fifty years as an entity separate and distinct form
Pennsy Supply, Inc. (with comma). This claim was based on a share certificate, dating to 1963,
which was held by Mumma and which facially represented shares in a corporation known as
Pennsy Supply Inc. (with no comma). Mumma also requested a declaration that a 1961
shareholder's agreement, under which Mumma arguably had an option to purchase substantial
assets presently operated by Pennsy Supply, Inc. (with a comma), represented an enforceable
instrument.
3. The Complaint did not involve title to any real estate.

4. On May 17, 2002, and following a five-day nonjury trial, the Court found
for Pennsy.
5. On August 20,2002, Mumma appealed the May 17,2002, Opinion and
Decree Nisi to the Pennsylvania Superior Court. On July 8,2003, the Superior Court affirmed
the trial court's decision in favor ofPennsy. On July 22, 2003, Mumma filed an Application for
Reargument. The Application for Reargument was denied by the Superior Court on September
18,2003.
6. On October 4, 2005, Mumma, pro se, filed a "Praecipe to Attach Deed
and Index As Lis Pendens" to the above captioned docket number.
7. A review of the Deed which Mumma attached to his Lis Pendens notice is
a Deed for certain real property located in Silver Spring Township, Cumberland County,
Pennsylvania, which was conveyed by Robert M. Mumma, Norman Sheesley and Earl V.
Compton, Liquidating Trustees of Highspire Sand and Gravel Company, Limited, and Robert M.
Mumma and Dauphin Deposit Trust Company to Pennsy Supply Inc.
8. Pennsylvania case law dictates that a lis pendens may only be indexed
when title to the real estate itself is involved in a suit. See U.S. Bank in Johnstown v. Johnson,
506 Pa. 622, 487 A.2d 809 (1985).
9. The doctrine of lis pendens is appropriately invoked only when a specific
property is the subject matter of the suit before the court. See Archibald v. General Construction
Associates. Inc., 7 Pa. D&C.3d 427, 436 (C.C.P. Bucks 1978).
10. The property referenced in the Deed attached to Mumma's lis pendens
bears absolute no relationship to the subject matter property involved in this litigation, nor does it
bear any relationship to the issues that were raised and adjudicated in this action.

10. Pennsy has been and will continue to be prejudiced by the filing of the lis
pendens.
11. The filing of a lis pendens against property that has nothing to do with the
issues previously raised and finally adjudicated in this action and thus Mumma's filing of the lis
pendens constitutes an abuse of process for which sanctions in the form of counsel fees and costs
should be imposed.
WHEREFORE, Pennsy Supply, Inc. hereby respectfully requests this Court grant its
Motion to Strike Lis Pendens, impose sanctions in the form of counsel fees and costs against
Mumma for the improper filing of the lis pendens, and further award Pennsy Supply, Inc. all
such other relief as is proper and just.

Agreement signed by Mumma on March 17, 1995 and adjudicating said Consent and Joinder
Agreement a nullity.
3. On October 4, 2005, Mumma, pro se, filed a "Praecipe to Attach Deed and
Index As Lis Pendens" to the above captioned docket number.

4. A review of the Deed which Mumma attached to his Lis Pendens notice is
