Diehl, and files the following "Petition For Citation To Show Cause Why An Account Should Not Be Filed In Accordance With 20 Pa.C.S.A. 93501.1" averring as follows: 1. Petitioner, Michelle Angela Fogle, is an adult individual, with a primary address of 5290 Davenport Lane, Dublin, Ohio, 43016. 2. Respondent Mark Andreas Fogle, a Co-Administrator of the Estate of Magda Fogle, is an adult individual with a primary address of 77 Yellowood Drive, Downingtown, Pennsylvania, 19335. 3. Respondent Terry William Fogle, a Co-Administrator of the Estate of Magda Fogle, is an adult individual with a primary address of 358 Moore Street, Millersburg, Pennsylvania, 17061. 4. Respondent Edward Lee Fogle, a Co-Administrator of the Estate of Magda Fogle, is an adult individual with a primary address of 75 Tonden Drive, York, Pennsylvania, 17402. 5. Petitioner is the adopted child of the Decedent. See Certificate of Adoption attached hereto as Exhibit "A". 6. Respondents are the biological children of the Decedent. 7. The Decedent's spouse, Luther A. Fogle, pre-deceased her on September 24, 1978. 8. It is believed and therefore averred that Petitioner and Respondents are all of the legal heirs of Magda Fogle. 9. This Honorable Court has jurisdiction over this matter pursuant to 20 Pa.C.S.A. 9 711(1),20 Pa.C.S.A. 9711(12), and 20 Pa.C.S.A. 93501.1. 10. Magda Fogle (hereinafter referred to as the "Decedent"), formerly a resident of Upper Allen Township, Cumberland County, Pennsylvania, died testate on May 8, 2005. A copy of the Decedent's Last Will and Testament is attached hereto as Exhibit "B." 11. On or about May 31, 2005, the Decedent's will, which was executed on September 23, 1964, was probated at the Cumberland County Register of Wills, and a Decree of Probate and Grant of Letters of Administration C.T.A. was granted to Mark Andreas Fogle, Terry William Fogle, and Edward Lee Fogle, the Respondents herein. A copy of the Decree of Probate and Grant of Letters is attached hereto as Exhibit "C". 12. At the time of said appointment through the present date Respondents have elected to administer the Estate of Decedent pro se. 13. Upon written demand of the Cumberland County Register of Wills dated August 15,2005, Respondents filed a Certification of Notice Under Rule 5.6(a) on September 2, 2005. Copies of said correspondence and Certificate of Notice Under Rule 5.6(a) are attached hereto as Exhibits "D" and "E" respectively. 14. Petitioner did not receive any Notification of Beneficial Interest from Respondents as required under Orphans' Court Rule 5.6(a). 15. It is believed and therefore averred that no advertisements of the Estate have been undertaken by the Respondents as required by 20 Pa.C.S.A. 9 3162. 16. It is further believed and therefore averred that real estate belonging to the Decedent was sold by Respondents on or about September 15, 2005 for a gross sale price of One Hundred Seventy-One Thousand Nine Hundred ($171,900.00) Dollars. A copy of the recorded Administrator's Deed is attached hereto as Exhibit "F". 1 7. In reliance upon the terms of Respondent's Petition for Probate and Grant of Letters, it is believed and therefore averred that the sale of Decedent's real estate on or about September 15,2005 represents the liquidation of Decedent's single largest asset. A copy of the Petition for Probate and Grant of Letters is attached hereto as Exhibit "Goo. 18. The nine month deadline for filing a Pennsylvania Inheritance Tax Return for the Estate of Magda Fogle occurred on February 8, 2006. 19. To date, no Pennsylvania Inheritance Tax Return for the Estate of Magda Fogle has been filed with the Cumberland County Register of Wills. 20. To date, no additIOnal admmIstratIve tilmgs have been undertaken by Respondents on behalf of the Estate of Magda Fogle since the September 2, 2005 filing of Certification of Notice under Rule 5.6(a). 21. Multiple attempts to contact Respondents by written correspondence and certified mailings have yielded no response and prompted no further administrative filings by Respondents with the Cumberland County Register of Wills. 22. It is believed and therefore averred that Respondents' failure to notify Petitioner of a potential beneficial interest in Decedent's estate coupled with Respondents' failure to respond to Petitioner's written demands for a status report on the administration of Decedent's estate indicates Respondents intend to exclude Petitioner from an equal distribution from the estate of Decedent. 23. It is in the best interests of the legal heirs and creditors of the Decedent to ascertain the administrative status and disposition of Decedent's estate in a timely fashion. WHEREFORE, Petitioner respectfully requests that this Honorable Court direct the Cumberland County Register of Wills to issue a Citation upon Respondents to Show Cause Why An Account Should Not Be Filed, and to further direct Respondents to undertake the immediate advertisement of the Grant of Letters, to file an Account of the Estate of Magda Fogle within thirty (30) days, and to file a Pennsylvania Inheritance Tax Return with the Cumberland County Register of Wills within a practicable period and whatever other relief this Honorable Court deems just and proper.
