STENCE, of 824 Pamelas Lane, Mechanicsburg, Pennsylvania 17050 (hereinafter collectively called "Owners"), are about to execute contemporaneously herewith, a contract with Carlson Construction, Inc., having a principal place of business at 1208 Summit Way, Mechanicsburg, Pennsylvania 17050 (hereinafter together called "Contractor"), for the erection of a dwelling house upon a lot of land situate and described as follows: See EXHIBIT "A" attached hereto and incorporated herein. NOW, April :2~, 2006, at the time of and immediately before the execution of the principal contract, and before any authority has been given by Owners to Contractor to commence work on the said building, or to purchase materials for the same, in consideration of the making of the said contract with Contractor and the further consideration of One and 00/100 ($1.00) Dollar, to Contractor paid by Owners, it is agreed that no lien shall be filed against the above described premises and the building and improvements to be erected thereon, by Contractor, or any subcontractor, or by any of the materialmen or workmen, or any other person for any labor provided or materials purchased, or for extra labor provided or materials purchased for the erection of said building and improvements, the right to file such liens being expressly waived. EXIllBIT "A" - LEGAL DESCRIPTION ALL THAT CERTAIN parcel of land located in the Township of Silver Spring, County of Cumberland, Commonwealth of Pennsylvania, being shown and designated as lot 6 on a plan entitled "Subdivision Plan for Sage Crest", dated August 14,2003 and last revised April 28, 2005. BEING commonly known and numbered 39 Sage Crest Circle, Enola (Silver Spring Township, Cumberland County), Pennsylvania 17025. Being also identified as Cumberland County Tax Parcel No. 38-05-0437-068. BEING THE SAME PREMISES which Howard K. Brown and Virginia J. Brown, husband and wife, by their Deed dated May 9, 2003 and recorded May 12, 2003 in Cumberland County Deed Book 256, Page 4968, granted and conveyed unto Edward G. Stence and Stephanie L.
