' 2006, by and between Hoffman's CustOll\ Contracting, Inc., of 35 Chelsea Lane, Cumberland County, Carlisle, Pennsylvania, hereinafter referred to as Contractor, AND DAVID W. GREEN AND BARBARA B. GREEN, husband and wife, hereinafter referred to as Owners. Whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Dickinson Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot #36, Chelsea Lane, Cumberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Exhibit A ALL THAT CERTAIN lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, bounded and described in accordance with the Final Subdivision Plan for Kings Gap Estates recorded on April 10, 1992, in the hereinafter named Recorder's Office in Plan Book 64, Page 48, etc., as follows: BEGINNING at a point on the northern right-of-way line of 60 foot wide Chelsea Lane at the dividing line between Lot No. 35 and Lot No. 36; thence along said northern right-of- way line of 60 foot wide Chelsea Lane North 81 degrees 00 minutes 45 seconds West, a distance of 136.18 feet to a point; thence by same by a curve to the right baving a radius of 200.00 feet an arc distance of 13.82 feet to a point in the dividing line between Lots Nos. 36 and 37; thence along tbe dividing line between Lots Nos. 36 and 37 North 03 degrees 34 minutes 36 seconds East a distance of324.10 feet to a point in the dividing line between Lots Nos. 36 and 39: thence along the dividing line between Lots Nos. 36 and 39 North 83 degrees 29 minutes 38 seconds East a distance of 173.66 feet to a point in the dividing line between Lots Nos. 35 and 36; thence along the dividing line between Lots Nos. 35 and 36 South 06 degrees 51 minutes 35 seconds West a distance of 369.72 feet to a point in the northern right-of-way line of 60 feet wide Chelsea Lane, the place of BEGINNING. THE ABOVE-DESCRmED lot of land is all of Lot No. 36 as shown on said Subdivision Plan for Kings' Gap Estates recorded as aforesaid, and contains an area of 55,361 square feet, or 1.27 acres, more or less. THE ABOVE-DESCRIBED Lot #3'6 has the mailing address of 32 Chelsea Lane, Carlisle, PA 17013.
