GETTYS~S AND YVONNE W. GETTYS, HUSBAND AND WIFE hereinafter referred to as Owner, whereby the former undertook and agreed to construct a single family dwelling, in Lots 9 91 & ~92 North Rid§e Subdivision, North Mlddleton Township, Cumberland 'County, Pennsylvania as further described in Exhibit "A" attached hereto and by this reference made a part hereof. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Signed, Sealed and Delivered in the presence of PREMIER BUILDERS (SEAL) (SEAL) (SEAL) re\ded\NORTHRIDGE191 ALL THAT CERTAIN lot of land situate in North Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point on the eastern side of Cedar View (50 feet) at the southwestern corner of Lot No. 90 on the hereinafter mentioned Plan of Lots; thence along Lot No. 90 South 70 degrees 06 minutes 12 seconds East 141.72 feet to a point on Phase Three; thence by the same South 11 degrees 12 minutes 00 seconds West 69.32 feet to a point at Lot No. 92; thence by Lot No. 92 North 85 degrees 49 minutes 37 seconds West 147.43 feet to a point on Cedar View; thence along Cedar View the following two courses and distances: (1) by a curve extending to the right in a northeasterly direction and having a radius of 275.00 feet an arc distance of 75.47 feet to a point; (2) North 19 degrees 53 minutes 48 seconds East 33.95 feet to the place of BEGINNING. Containing 13,062.41 square feet. BEING Lot No. 91 on a Final Subdivision Plan for North Ridge Phase II made by Hartman and Associates, Inc., for Fred A. Gettys and recorded in Cumberland County Plan Book 76, Page 74. UNDER AND SUBJECT, also, to all restrictions, reservations, conditions, and easements set forth on the recorded Plan of Lots or appearing in prior instruments of record. BEING a part of the premises which Robert L. Noll and Mary E. Noll, his wife, by their deed dated December 31, 1986, and recorded in Cumberland County Deed Book K, Vol. 32, Page 875, granted and conveyed unto Fred A.
