STIPULATION AGAINST LIENS
WHEREAS, James R. Ridd and Christine B. Ridd, husband and wife, of
Cumberland, Pennsylvania, is about to execute contemporaneously herewith, a contract with J.A.
Halbert Builder, LLC, a limited liability company of Dauphin County, Pennsylvania, for the erection
of a dwelling upon a lot of land situate as follows:
TRACT NO. 1
ALL THAT CERTAIN tract or parcel of land and premises, situate, lying and being
in Upper Allen Township, in Cumberland County, Pennsylvania as shown on a Final Subdivision
Plan of Bowmans Hill Lots 1 and 2 prepared by Dawood Engineering, Inc., as recorded in the Office
of the Recorder of Deeds in and for Cumberland County, Pennsylvania on August 12, 1997 in Plan
Book 75, Page 41, more particularly bounded and described as follows:
BEGINNING at point on the northern side of Round Ridge Road and the
southwestern comer of Tract No. 2-B; thence by the northern line of Round Ridge Road South 58
degrees 13 minutes 35 seconds West, a distance of 30.00 feet to point at the southeastern comer of
Tract No. 2-D; thence North 31 degrees 46 minutes 24 seconds West, a distance of 156.18 feet to
a point at the northeastern comer of Tract No. 2-D; thence North 45 degrees 01 minute 42 seconds
East, a distance of 30.81 feet to a point at the northwestern comer of Tract No. 2-B; thence South
31 degrees 46 minutes 24 seconds East, a distance of 163.22 feet to the point and place of
BEGINNING.
SAID TRACT NO. 2-C being subject to a 25 foot wide drainage easement along the
northern portion of the lot being more fully shown on the above referenced final plan.
TRACT NO. 2
ALL THAT CERTAIN tract or parcel of land and premises, situate, lying and being
in Upper Allen Township, in Cumberland County, Pennsylvania as shown on a Final Subdivision
Plan of Bowmans Hill Lots 1 and 2 prepared by Dawood Engineering, Inc., as recorded in the Office
of the Recorder of Deeds in and for Cumberland County, Pennsylvania on August 12, 1997 in Plan
Book 75, Page 41, more particularly bounded and described as follows:
BEGINNING at a point on the northern side of Round Ridge Road and the
southwestern comer of Tract No. 2-C; thence by the northern line of Round Ridge Road South 58
degrees 13 minutes 35 seconds West, a distance of 27.49 feet to a point; thence by the same along
a curve to the left having a chord bearing of South 57 degrees 21 minutes 15 seconds West, a
distance of 17.51 feet, a radius of 575.00 feet and an arc distance of 17.51 feet to a point at the
southeastern comer of Tract No. 2-E; thence North 31 degrees 46 minutes 24 seconds West a
distance of 145.90 feet to a point at the northeastern comer of Tract No. 2-E; thence North 45
degrees 01 minute 42 seconds East, a distance of 47.23 feet to a point at the northwestern comer of
Tract No 2-C; thence South 31 degrees 46 minutes 24 seconds East, a distance of 156.18 feet to the
point and place of BEGINNING.
SAID TRACT NO. 2-D being subject to a 25 foot wide drainage easement along the
northern portion of the lot being more fully shown on the above referenced final plan.
NOW, the o~-'¢- dayof /vi (~--(dd _,2002, at the time ofand immediately
before the execution of the principal contract, and before any authority has been given by the said
James R. Ridd and Christine B. Ridd, husband and wife, to the said J.A. Halbert Builder, LLC, a
limited liability company to commence work on the said building, or purchase materials for the
same in consideration of the making of the said contract with J.A. Halbert Builder, LLC, a limited
liability company and the further consideration of One Dollar, to J.A. Halbert Builder, LLC, a limited
liability company paid by James R. Ridd and Christine B. Ridd, husband and wife, it is
agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by
any of the material men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
