WHEREAS, John J. Bogonis, III and Nadeen J. Bogonis of 60 Sam Snead Circle, Etters, PA
17319, is about to execute contemporaneously herewith, a contract, with Bob Lehman
Construction of Carlisle, PA, for the erection of a building upon premises commonly known
as 110 West Harmon Drive, Township Dickinson, Cumberland County, Pennsylvania, as set
forth in the deed dated 03/25/05, recorded at Book 268, Page 536, in the Recorder's Office
for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is
incorpora~d herein and attached hereto.
Now?!~tfhe time of and immediately before the execution of the principal contract, and
before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making
of the said contract with Contractor and the further consideration of One Dollar ($1.00), to
contractor paid by OWner, it is agreed that no lien shall be filed against the building by the
Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.

ALL that certain tract of land situate i~ Dickinson Township, Cumberland
County, Pennsylvania, more particplarly bounded and described pursuant to
Preliminary/Final Subdivision Plan for Rockwell Farms, recorded in Cumberland
County Plan Book 64, Page 18, as follows:
BEGINNING at a point on the right of Way line of the cul-de-sac of Harmon
Drive, which point is at common comer ofLo~s Nos. 45, 46 and 71 as shown on the
above-described subdivision plan; thence by Said Lot No. 71, North 70 degrees 50
minutes 53 seconds East 406.84 feet to a point In line of Lot No.48 as shown on Final
Subdivision Plan for Rockwell Farms recorded: in Cumberland County Plan Book 63,
Page 79B; thence by Lot No. 48 and Lot No. 47 as shown on said last mentioned
plan, North 39 degrees 48 minutes 35 second,S West 493.21 feet to a point on the
right of way line of Harmon Drive; thence by the right of way line of Harmon Drive
by a curve to the left having a radius of447.88!feet, an arc distance of439.69 feet to
a point; thence continuing by said right ofwayiline, South 12 degrees 03 minutes 18
seconds East 52.09 feet to a point on said rightofway line; thence continuing by the
right of way line of the cul-de-sac of Harmon Drive by a curve to the left having a
radius of 40.00 feet, an arc distance 000.55 feet to a point; thence continuing by said
rig/lt of way line of the cul-de-sac of Harmon Drive by a curve to the right having a
radius of 50.00 feet, an arc distance of38.19 feet to a point and said right of way line,
the point and place of BEGINNING.
CONTAINING 2.88 acres or I 25,604 , square feet and being designated Lot
No. 46 as shown on the first above-described PreliminaryIFinal Subdivision Plan for
Rockwell Farms.
