AND NOW, comes the Appellant, Abby A. Spidle, by and through her attorneys, the Law
Offices of Patrick F. Lauer, Jr., LLC, respectfully avers the following:
1. Appellant resides at 305 Lafayette Drive, New Cumberland, Cumberland County,
Pennsylvania 17070.
2. Appellant received a Notice dated April 10, 2006, that as a result of her alleged
violation of Vehicle Code Section 1547 Chemical Test Refusal on March 24, 2006, her driving
privileges were being suspended for a period of one year (1), effective suspension date May 15,
2006, at 12:01 a.m.
3. Appellant did not fail any field sobriety test.
4. Appellant submits that the police officer lacked a reasonable basis to request
Appellant to submit to a chemical test.
5. Appellant did not interfere with the administration of breath testing.
6. Appellant submits that she did not knowingly or consciously refuse to submit to
chemical testing.
7. Appellant submits she was not told she would lose her license for one year if a test
result was not obtained
8. Appellant blew into the breathalyzer on numerous occasions and the failure to
obtain a result was not through the fault of Appellant.
9. Appellant submits that her actions did not constitute a refusal.
WHEREFORE, your Appellant respectfully requests your Honorable Court to schedule an
evidentiary hearing on the matter.

MOTION FOR CONTINUANCE
The Commonwealth of Pennsylvania, Department of Transportation, Bureau of Driver
Licensing (Department), by and through its attorney, George H. Kabusk, Esquire, respectfully
represents as follows:
1. The Department mailed to Abby A. Spidle, O.L.N. 25907172, a notice dated April
10, 2006, informing the petitioner that as a result of the petitioner's violation of
Section 1547 of the Vehicle Code, relating to Chemical Test Refusal, on Marcy 24,
2006, the petitioner's driving privilege was being suspended for a period of 1 year as
mandated by Section 1547 of the Vehicle Code.
2. The petitioner filed an appeal of the above mentioned suspension in the Court of
Common Pleas of Cumberland County.
3. A hearing in the matter is scheduled for July 28,2006, at 10:30 a.m. in Courtroom
Number 5 of the Court of Common Pleas of Cumberland County, Cumberland
County Courthouse, Carlisle, Pennsylvania.
4. The refusal was reported to the Department of Transportation by Officer Michael
Bingham of the Camp Hill Police Department.
5. Officer Bingham is a necessary witness for the Department's case.
6. Officer Bingham is scheduled for training on July 28, 2006, and will be unavailable
to testify on July 28, 2006.
7. The motorist's operating privilege has been restored pending appeal pursuant to
Section 1550 of the Vehicle Code.
8. The undersigned counsel contacted the office Patrick F. Lauer, Jr, Esquire, attorney
for the petitioner, and Mr. Lauer's secretary reported that Mr. Lauer does not
objection to the granting of a continuance in this matter.
9. The undersigned counsel respectfully requests a continuance and that the case be
rescheduled for hearing.
WHEREFORE, the Department respectfully requests that the Department's Motion For
Continuance be granted and that the aforesaid hearing be continued and rescheduled.
