The relationship of the Plaintiff to the child is that ofrnother. 10. The relationship of the Defendant to the child is that of father. II. Plaintiff does not know of a person not a party to the proceedings who has physical custody of the child and claims to have custody or visitation rights with respect to the child. 12. Each parent whose parental rights to the child have not been terminated and the person who has physical custody of the child have been named as parties to this action. 13. The best interests and permanent welfare of the child will be served by granting the relief requested. The quality ofthe child's physical, intellectual, moral and spiritual environment would be improved by Plaintiffs increased and continuing involvement in the Child's life. . . JAMES SUTCH, IN CUSTODY Defendant TEMPORARY ORDER OF COURT AND NOW, this I ~ l' day of I\u~~~ t , 2006, upon consideration of the attached Custody Conciliation Summary Report, it is hereby ordered and directed as follows: 1. Leaal Custody. The parties, Suzanne Sutch and James Sutch, shall have shared legal custody of the minor child, Jared Sutch, born November 2, 1998. Each parent shall have an equal right, to be exercised jointly with the other parent, to make all major non-emergency decisions affecting the child's general well-being including, but not limited to, all decisions regarding his health, education and religion. Pursuant to the terms of 23 Pa. C. S. ~5309, each parent shall be entitled to all records and information pertaining to the child including, but not limited to, medical, dental, religious or school records, the residence address of the child and of the other parent. To the extent one parent has possession of any such records or information, that parent shall be required to share the same, or copies thereof, with the other parent within such reasonable time as to make the records and information of reasonable use to the other parent. 2. Physical Custody. Mother shall have primary physical custody subject to Father's rights of partial custody, which shall be arranged as follows: A. Commencing July 21, 2006, on alternating weekends, from Friday atter school or work until Monday, when the child is returned to school or day care. B. Commencing July 26, 2006, on alternating Wednesdays from after school or work until Thursday morning. C. Commencing August 2, 2006, on alternating Wednesdays from after school or work until 9:15 p.m. (summer schedule) or 8:30 p.m. (school year schedule). D. The parties further contemplate that Father will have additional periods of custody which may fall on other than Wednesday evenings for purposes of mutually agreed upon sports activities or competitions. , " NO. 06-2856 CIVIL TERM The child will continue to participate in his current sports of baseball and soccer. Additional sports or circular activities will be subject to the mutual consent of the parties, which consent shall not be unreasonably withheld. 3. Vacation. Each parent shall be entitled to two non-consecutive weeks of vacation each year, Saturday to Saturday, to include the vacationing parent's custodial weekend. The parties shall provide each other with notice by April 1s of their planned vacation time. In the event that the parties have arranged conflicting schedules for vacation, the party first providing written notice to the other party shall have choice of the vacation week. Additionally, prior to departure, the vacationing parent shall provide a telephone number and location where they can be reached during the vacation. 4.
