COMPLAINT FOR CUSTODY
1. The Plaintiff is Katherine A. Hostetler, an adult individual who resides at 1213
Edinburgh Circle, New Cumberland, Cumberland County, PA 17070.
2. The Defendant is William K. Hostetler, an adult individual who resides at 105
Greenwood Drive New Cumberland, York County, Pennsylvania, 17070.
3. The Plaintiff seeks custody of the following child:

The child is presently in the physical custody of her Mother, who resides at the
address above. The child was legally adopted by the parties in July 1997.
4. The child resided with both parties at 105 Greenwood Drive, New Cumberland,
Pennsylvania until November 2004 when the parties separated.
5. The child has resided primarily with Mother since November 2004 at 1213
Edinburgh Circle, New Cumberland, Cumberland County, PA 17070.
6. The Mother of the child is Katherine A. Hostetler, currently residing at 1213
Edinburgh Circle, New Cumberland, Cumberland County, Pennsylvania. Her marital status
is separated.
7. The Father of the child is William K. Hostetler, currently residing at 105
Greenwood Drive, New Cumberland, York County, Pennsylvania.
8. The relationship of the Plaintiff to the child is that of Mother. Plaintiff
currently resides with the following persons:

9. The relationship of the Defendant to the child is that of Father. Defendant
currently resides alone.
A custody action was pending in York County, Pennsylvania under Docket No. 2004-
FC-1608-Y03 but was dismissed in November 2004. See Memorandum attached hereto as
Exhibit A.
Plaintiff has no information of custody proceedings for the child pending in a Court
of this Commonwealth.
Plaintiff does not know of a person not a party to the proceedings who has physical
custody of the child or claims to have custody or visitation rights with the child.
10. The best interest and permanent welfare of the child will be served by granting
the relief requested because:
a. Plaintiff has been the primary care giver of the child and has provided
the child with consistent and loving care.
b. Plaintiff is willing and able to continue to provide proper care and
supervision of the child.
c. Plaintiff can provide a stable and loving environment to the child.
d. The child has resided primarily with the Plaintiff since November 2004.
11. Each parent whose parental rights of the child have not been terminated and
the person who has physical custody of the child have been named as parties to this action.
There are no other persons who are known to have a claim or right to custody or visitation
in this matter.
WHEREFORE, Plaintiff requests the Court to grant primary physical and legal
custody of the child to the Plaintiff with partial physical custody to Defendant.

MEMORANDUM
The Complaint in this matter was dismissed by the Court for failure to proceed
within the time limits set by the Rules of Civil Procedure. Therefore, no Conciliation
Conference could be held on November 16.
The Plaintiffs Counsel had secured a directive for a new Conciliation
Conference even though the case had been dismissed. The Plaintiffs Counsel has
indicated that the parties no longer reside together. The case would then be ripe for
ajudication. However, a new action will have to be filed and a new directive sought
from the District Court Administrator.

consideration of the attached Custody Conciliation Report, it ordered and directedas follows:
1. The Mother, Katherine A. Hostetler, and the Father, William K. Hostetler, shall have shared
legal custody of Noelle "Katie" Hostetler, born July 4, 1994. Each parent shall have an equal right, to
be exercised jointly with the other parent, to make all major non-emergency decisions affecting the
Child's general well-being including, but not limited to, all decisions regarding her health, education
and religion. Pursuant to the terms of this paragraph each parent shall be entitled to all records and
information pertaining to the Child including, but not limited to, school and medical records and
information.
2. The parties shall have physical custody of the Child in accordance with the following
schedule:
A. During the school year, the Mother shall have custody of the Child beginning after
school on Thursday through the end of the school day on Monday in every week,
and the Father shall have custody from after school on Monday through the end of
the school day on Thursday in every week.
B. During the summer school break, in every week, the Mother shall have custody of
the Child from Thursday at 4:00 p.m. through Monday at 12:00 noon and the Father
shall have custody from Monday at 12:00 noon through Thursday at 4:00 p.m.
C. Throughout the year, the Father shall have custody of the Child on alternating
Sundays from 10:00 a.m. until 2:00 p.m. for the purpose of taking the Child to
church. So long as CCD classes are in session, the Mother shall have custody of the
Child on alternating Wednesdays for a sufficient time period to take the Child to
CCD class and, during the interim weeks, the Father shall be responsible to
transport the Child to and from the CCD class.
D. The foregoing custody schedule is contingent upon the Father's residence in the
school district in which the Child would attend the Crossroads Middle School and is

also contingent upon the Child's actual enrollment at the Crossroads Middle School.
To verify the Father's residence, the Father shall provide, through counsel, a copy of
the lease for the Father's residence to the Mother as soon as possible following the
custody conciliation conference and the Mother shall contact the Crossroads Middle
School to confirm that the Child is enrolled for attendance during the 2006-2007
school year.
3. Each party shall be entitled to have custody of the Child for one uninterrupted week during
the summer school break each year upon providing at least 30 days advance notice to the other party of
the selected dates. The party providing notice first shall be entitled to preference on his or her
selection of vacation dates under this provision.
4. The parties shall share having custody of the Child on holidays as arranged by agreement.
5. The Mother shall provide all transportation for exchanges of custody of the Child on the
alternating Wednesdays when the Mother shall transport the Child to CCD class and the Father shall
provide transportation for all exchanges of custody on alternating Sundays when the Father takes the
Child to church. In all other instances, the parent receiving custody of the Child shall be responsible to
provide transportation for the exchange, unless otherwise agreed between the parties.
6. The parties shall consult with each other prior to enrolling the Child in extracurricular
activities. The parties shall cooperate with each other in scheduling all activities for the Child and
shall ensure that the Child attends all regularly scheduled activities during his or her periods of
custody. .
7. Neither party shall do or say anything which may estrange the Child from the other parent,
injure the opinion of the Child as to the other parent, or hamper the free and natural development of the
Child's love and respect for the other parent. Both parties shall ensure that third parties having contact
with the Child comply with this provision.
8. This Order is entered pursuant to an agreement of the parties at a custody conciliation
conference. The parties may modify the provisions of this Order by mutual consent. In the absence of
mutual consent, the terms of this Order shall control.

OF A CUSTODY ORDER
1. The Petition of WILLIAM K. HOSTETLER represents that on
AUGUST 2, 2006, an ORDER of Court was entered for partial custody of the
parties child, Noelle "Katie" Hostetler, born July 4, 1994. A true and correct
copy of such Order is attached hereto, made a part hereof, and marked Exhibit
"A»
2. This ORDER should be modified because:
A. The Respondent's household is overcrowded;
B. The child, Noelle "Katie" Hostetler, does not have her own room
at the Respondent's house.
C. The Respondent is a "recovering alcoholic" but continues to drink
alcohol.
D. The child has repeatedly and regularly told your Petitioner
that she wants to live mainly with Petitioner and at Petitioner's home.
E. The child does not get along with Respondent's new
boyfriend.
3. The conciliator previously appointed for a Pre-Hearing Conference
was Dawn S. Sunday, Esquire, 39 W. Main St., Mechanicsburg, PA 17055.
WHEREFORE, Petitioner requests that the Court modify the existing
ORDER because it will be in the best interest of the child.

AND NOW, Wednesday, May 28, 2008 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Dawn S. Sunday, Esq. , the conciliator,
at 39 West Main Street, Mechanicsburg, PA 17055 on Monday, June 16, 2008 at 1:00 PM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

AND NOW, this 2 day of ru, L , 2008, upon
consideration of the attached Custody Conciliation Report, it is ordered and directed as follows:
1. The parties shall submit themselves, their minor child, and any other individuals deemed
necessary by the evaluator to a custody evaluation to be performed by Arnold Shienvold, Kasey
Shienvold, or other professional selected by agreement between the parties. The purpose of the
evaluation shall be to obtain independent professional recommendations concerning ongoing custody
arrangements which will best meet the needs of the Child. All costs of the evaluation shall be shared
equally between the parties. The parties shall sign any authorizations deemed necessary by the
evaluator in order to obtain additional information pertaining to the parties or the Child. Both parties
shall cooperate in ensuring that the custody evaluation is completed on a timely basis.
2. The Father shall provide the original or a copy of the Child's report cards promptly to the
Mother upon receipt from the school and shall notify the Mother in advance of any scheduled meetings
with school personnel concerning the Child.
3. Within sixty (60) days of receipt of the written custody recommendations, counsel for either
party may contact the conciliator to schedule an additional custody conciliation conference, if
necessary.
4. Pending completion of the custody evaluation and further Order of Court or agreement of
the parties, the prior Order of this Court dated August 2, 2006 shall continue in effect.
