MUNICIPAL LIEN MUNICIPAL LIEN MUNICIPAL LIEN FOR SERVICES AND SEWER RATES AND NOW, comes Monroe Township Municipal Authority, of 1220 Boiling Springs Road, Mechanicsburg, Pennsylvania, by and through its Solicitors, James D. Bogar, Esquire, and Jennifer B. Hipp, Esquire, and files the following municipal claim against ROBERT RYAN, JR. and MICHELLE RYAN, husband and wife, adult individuals, owning property located at 1359 Zimmerman Road, Carlisle, Monroe Township, Cumberland County, Pennsylvania, 17013, their last known mailing address being: 1359 Zimmerman Road, Carlisle, Pennsylvania, 17013. ROBERT RYAN, JR. and MICHELLE RYAN, husband and wife, are the owners of all that certain lot of ground, including any improvements thereon, being more fully described as follows: b. ALL THAT CERTAIN house and lot of ground situate in Monroe Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a spike in the center of the public road leading from Churchtown to the York Road at the line of land now or formerly of Dr. William Brod; thence by said latter lands, South 77 degrees 30 minutes West, 159.5 feet to a point; thence by lands formerly of Merle Edward Miller, et. ux., North 30 degrees 30 minutes West, 51.5 feet to a stake; thence by land now or formerly of Wilson P. Hurley and Helen L. Hurley, his wife, North 59 degrees 30 minutes East, 150 feet to a spike in the center of the aforesaid public road; thence by the center of said road, South 30 degrees 30 minutes East, 100 feet to a spike, the place of BEGINNING. SAID premises being described in accordance with a survey of W. G. Rechel, Registered Surveyor, dated October 8, 1958. THE ABOVE-DESCRIBED premises having erected thereon a dwelling house and other improvements with a mailing address of 1359 Zimmerman Road, Carlisle, Pennsylvania 17013. BEING the same premises which Paul E. Hoffman and Florence N. Hoffman, husband and wife, and Donald R. Ohrum, single individual, by their deed dated June 2, 2004 and recorded June 7, 2004 in the Cumberland County Recorder of Deeds Office in Deed Book 263, Page 2066 granted and conveyed unto Robert Ryan, Jr. and Michelle Ryan, husband and wife. Tax Parcel No. 22-10-0640-043 Monroe Township Municipality Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from June 2, 2004 through and including March 31, 2006 (second quarter calendar year 2004 through and including first quarter calendar year 2006). Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02- 04, same being known as a Resolution of the Board of Monroe -2- Township Municipal Authority imposing user charges to be collected from the owner of each improved property served or to be served by this Authority's sewer systems; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to ROBERT RYAN, JR. and MICHELLE RYAN for sewerage due to be treated from June 2, 2004 through and including March 31, 2006 (second quarter calendar year 2004 through and including first quarter calendar year 2006), which services total is in the amount of $1,653.50, which sum was duly assessed against ROBERT RYAN, JR. and MICHELLE RYAN, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10%) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above-described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as -3- amended, 53 P.S Tax Liens). §7101, et seq, as amended (Municipal Claims and Date: May 17, 2006 MONROE T-QWNSHIPnMQNICIPAL AUTHORITY By: w -if Ja es D- B g r, Esquire Attorney I D. Ryan, Jr. 1359 Zimmerman Road Carlisle, PA 17013 Dear Mr. Ryan: I am contacting you on behalf of Monroe Township relative to your sewer account #1159. This account is delinquent. As of the last billing notice, same being dated 2/15/06, the delinquency is in the amount of $1,65350. The purpose of this letter is to request that this account be brought current. If the account is not brought current within ten (10) days of receipt of this letter, a Municipal Lien will be placed against real estate owned by you, same being !mown and numbered as 1359 Zimmeramn Road, Carlisle, PA. This will result in filing fees, service costs and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed. Attorney's fees will be charged at the current rate. Attorney's fees will be imposed and/or assessed if this amount remains delinquent after thirty (30) days from the mailing of this notice (if by certified mail) or within ten (10) days after mailing of this notice (if by regular mail). The imposition of assessment of attorney's fees may be avoided by you making payment in full of the delinquency within ten (10) days of receipt of this letter as set forth herein.
