WENTZEL, Defendant COMPLAINT Plaintiff, Emma K. Weitzel, by her attorneys, Broujos & Gilroy, P.C., sets forth the following: 1. Plaintiff, Emma K. Weitzel, is an adult individual residing at 445 West Penn Street, Carlisle, Cumberland County, Pennsylvania. 2. Defendant, Emma W. Toth, a/k/a Emma C. Wentzel, is an adult individual residing at 242 West Pomfret Street, Carlisle, Cumberland County, Pennsylvania. 3. Plaintiff is the natural daughter of Defendant. 4. During Plaintiffs minority, Defendant, on various and numerous occasions, purchased or otherwise acquired assets for, in the name of, and on behalf of Plaintiff. These assets include, but are not limited to, stocks, savings bonds, and other investment vehicles, as well as, interest, dividends and other income earned thereon (collectively hereinafter referred to as "Plaintiffs Assets"). 5. Upon information and belief, Defendant held some or all of Plaintiffs Assets in guardianship and/or trust accounts which provided that the accounts and assets contained therein were to be transferred to Plaintiff upon Plaintiffs attaining the age of eighteen years. 6. Despite Defendant's obligation to do so, Defendant failed to transfer care, custody and control of Plaintiffs Assets to Plaintiff upon Plaintiff attaining the age of eighteen years. 7. Defendant misappropriated to her own use Plaintiffs Assets by the following actions: A. Selling some of Plaintiffs Assets and using the proceeds from said sales for Defendant's own use; B. Collecting dividends, interest and other income from Plaintiffs Assets and misappropriating the dividends, interest and other income to Defendant's own use and for Defendant's own benefit; C. Directing transfer of stocks or other of Plaintiffs Assets from Plaintiffs name into Defendant's name and, thereafter, misappropriating those assets for Defendant's own personal use; D. Such other actions as may be learned in discovery. 8. Plaintiff has been able to obtain some information verifying the actions of the Defendant as set forth above, but Plaintiff has been unable to obtain access to all information relating to Plaintiffs Assets in order to verify the exact nature and value of assets owned by the Plaintiff which Defendant has misappropriated. 9. Defendant fraudulently misappropriated Plaintiffs Assets as set forth above for the purposes of appropriating said assets to Defendant and to the detriment of the Plaintiff. 10. Defendant's said actions were arbitrary and capricious, and were committed in bad faith, without legal justification and were contrary to Plaintiffs recognized legal rights. 2 COUNT I - BREACH OF RESULTANT TRUST 11. Paragraphs 1-10, above, are incorporated herein by reference thereto. 12. Defendant held some or all of Plaintiffs Assets in a resulting trust for Plaintiff's benefit. 13. Defendant breached Defendant's duties as resulting trustee by failing to turn Plaintiff's Assets over to Plaintiff upon Plaintiff attaining the age of eighteen years and otherwise by misappropriating Plaintiff's Assets as aforesaid. WHEREFORE, the Plaintiff requests the following relief: A. That Defendant be held as a resultant trustee for Plaintiff for the money and other assets, and proceeds therefrom, received by Defendant from Plaintiffs accounts, which monies, assets and proceeds therefrom were never paid over to Plaintiff; B. That Defendant be ordered to account to Plaintiff for all monies received from the sale of Plaintiffs accounts; C. That, when an account is stated and approved, Defendant be ordered to pay over to Plaintiff the amount found due to Plaintiff by Defendant by the said account, plus interest; D. Defendant be ordered to pay Plaintiff the attorney's fees and costs incurred by Plaintiff in prosecuting this action, as allowed by law; E. Pre and post judgment interest as provided by law; and F. Any other relief deemed just by the Court. 3 COUNT II - CLAIM FOR ACCOUNTING 14. Paragraphs 1-13, above, are incorporated herein by reference thereto. 15. A detailed accounting is necessary in order for the Plaintiff to accurately learn what assets from the Plaintiffs accounts the Defendant misappropriated. WHEREFORE, the Plaintiff demands that the Defendant be directed to set forth and account for all of the gains and profits earned and received by the Defendant to which the Plaintiff is entitled to under the above cause of action so that the Plaintiff may have judgment against the Defendant for the amount shown to be due her by said accounting. COUNTIII-FRAUD 16. Paragraph 1-15, above, are incorporated herein by reference thereto. 17. Defendant is liable to Plaintiff for fraud, as she illegally misappropriated funds from the Plaintiff and concealed her actions with hopes of her actions not be detected by Plaintiff in order to deprive Plaintiff of Plaintiffs property. WHEREFORE, Plaintiff respectfully requests your Honorable Court to enter judgments as follows: A. That the Court order restitution for the monies misappropriated by Defendant from Plaintiff and that the Court direct judgment be entered in favor of Plaintiff in an amount of said restitution once the amount is determined after the accounting as set forth above; B. That the Court award compensation to Plaintiff for emotional distress as allowed by law and costs of suit; 4 C. That the Court award Plaintiff punitive damages and attorney's fees, as allowed by law and deemed just by the Court; D. That the Court award Plaintiff pre and post judgment interest and costs of suit, as allowed by law; and E. Such other relief as may be deemed appropriate. COUNT IV - CONVERSION - COMMON LAW 18. Paragraphs 1-17, above, are incorporated herein by reference thereto. 19. Defendant converted Plaintiffs property for her own use by selling Plaintiffs accounts or taking the monies from Plaintiffs accounts and accepting proceeds from Plaintiffs accounts. WHEREFORE, Plaintiff respectfully requests your Honorable Court to enter judgments as follows: A. That the Court order restitution for the monies misappropriated by Defendant from Plaintiff and that the Court direct judgment be entered in favor of Plaintiff in an amount of said restitution once the amount is determined after the accounting as set forth above; B. That the Court award compensation to Plaintiff for emotional distress as allowed by law and costs of suit; C. That the Court award Plaintiff punitive damages and attorney's fees, as allowed by law and deemed just by the Court; 5 D. That the Court award Plaintiff pre and post judgment interest and costs of suit, as allowed by law; and E. Such other relief as may be deemed appropriate. COUNT V - CLAIM FOR BREACH OF FIDUCIARY DUTY 20. Paragraphs 1-19, above, are incorporated herein by reference thereto. 21. Many, if not all, of the Plaintiffs accounts were held by Defendant in Defendant's fiduciary capacity as a Guardian of the account or pursuant to the Pennsylvania Uniform Gift to Minors Act. 22. Defendant owed a fiduciary duty to Plaintiff to properly care for and protect Plaintiff's funds and to account to Plaintiff for all of her assets. 23. Defendant breached the fiduciary duty owed to the Plaintiff by misappropriating Plaintiffs funds. 24. Defendant is liable to Plaintiff for damages caused by Defendant's breach of the fiduciary duties she owed to Plaintiff. WHEREFORE, Plaintiff respectfully requests your Honorable Court to enter judgments as follows: A. That the Court order restitution for the monies misappropriated by Defendant from Plaintiff and that the Court direct judgment be entered in favor of Plaintiff in an amount of said restitution once the amount is determined after the accounting as set forth above; 6 B. That the Court award compensation to Plaintiff for emotional distress as allowed by law and costs of suit; C. That the Court award Plaintiff punitive damages as allowed by law and deemed just by the Court; D. Such other relief as may be deemed appropriate. COUNT VI - CLAIM FOR CONSTRUCTIVE TRUST (In the Alternate) 25. Paragraphs 1- 24, above, are incorporated herein by reference thereto. 26. In the event that it is judicially determined that Plaintiff has no cognizable action as averred above, Plaintiff will have no full, complete and adequate remedy at law. 27. Defendant holds Plaintiffs Assets, and the proceeds therefrom as a constructive trustee for Plaintiffs benefit. 28. Plaintiff comes before your Equitable Court with clean hands. WHEREFORE, the Plaintiff requests the following relief: A. That the Defendant be held as a constructive trustee for the Plaintiff for the money and assets received by Defendant from the Plaintiffs accounts, which monies were never paid over to the Plaintiff; B. That the Defendant be ordered to account to the Plaintiff for all monies received from the sale of Plaintiffs accounts; 7 C. That, when an account is stated and approved, the Defendant be ordered to pay over to the Plaintiff the amount found due the Plaintiff by Defendant by the said account, plus interest. COUNT VII - UNJUST ENRICHMENT (in the alternate) 29. Paragraphs 1- 28, above, are incorporated herein by reference thereto. 30. In the event that it is judicially determined that Plaintiff has no cognizable or actionable cause of action as averred above, Plaintiff will have no full and adequate remedy at law. 31. If Defendant is allowed to retain Plaintiffs accounts and the benefits and interests therefrom, Defendant will be unjustly enriched and Defendant has no right to retain said property. 32. Plaintiff is entitled to a decree awarding Plaintiffs return of her property. 33. Plaintiff comes before your Equitable Court with clean hands. WHEREFORE, Plaintiff respectfully requests your Honorable Court to enter judgments as follows: A. Defendant's actions in appropriating and converting Plaintiffs accounts were arbitrary and in bad faith and justifies an award of attorney's fees pursuant to 42 PA.C.S.A. §2503.
