KNOW ALL MEN BY THESE PRESENTS, that we, the undersigned contractors, mechanics and material
men, for value received, have remised, released and waived, and by these presents hereby do, for ourselves and
our successors, heirs, personel representatives and assigns, remise, release and waive to and in favor of MAX D.
MARBAIN, his heirs, successors in title and assigns (equitable owner) and Upper Allen Partners, L. P. (record
owner) (together, "Owner") our right under the Pennsylvania Mechanics Lien lli\w of 1963, as amended, to file or
enter upon the record any mechanics lien or liens against all that certain tract qr ground, together with all
i!"prov~m~fllS thereon erected or to be thereon erected, now titled in the name! of the Owner, situate in
ltIlwld It'lli tl111S Upper Allen Township, Cumberland County, Pennsylvania (the "Property") as further described
and iden\ified as follows:
Unit 53 of Winding Hills, A Planned Community
for any and all work done upon and materials fumished for the erection, building and completion of improvement
to the Property free and clear of any present or future claims of any mechanics lien for any labor or materials
supplied to or to be supplied by us in or to toward any improvements to the above described Property. It is the
express intent of the parties to be legally bound hereby in accordance with the provisions of the Mechanics Lien
Law of 1963, as amended.
