OR- lb6 1 STIPULATION AGAINST LIENS WHEREAS, GLEN A. BANNON and MILDRED M. BANNON, of Carlisle, Cumberland County, Pennsylvania, is about to execute contemporaneously herewith, a contract with FINE LINE HOMES, INC. of Dauphin County, Pennsylvania, for the erection ora dwelling upon a lot of land situate as follows: ALL THAT CERTAIN piece or parcel situate in South Middleton Township, Cumberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the eastern right-of-way line of Overfield Drive at the common front property comer of Lot No 15 and Lot No. 16; thence along said right-of-way line of Overfield Drive North 14 degrees 12 minutes 10 seconds East, a distance of 150.00 feet to a point; thence by a curve having a radius of 15 feet and an arc length of 23.56 feet to a point on the southern right-of-way line of Essex Drive; thence along the southern right-of-way line of Essex Drive South 75 degrees 47 minutes 50 seconds East, a distance of 100.00 feet to a point at the dividing line between Lot No. 14 and Lot No. 16; thence along the said dividing line South 14 degrees 12 minutes 10 seconds West, a distance of 165.00 feet to a point at the dividing line between Lot No. 15 and Lot No. 16; thence along said dividing line North 75 degrees 47 minutes 50 seconds West, a distance of 115.00 feet to a point, said point being the Place of BEGINNING. CONTAINING 18,926.72 square feet. BEING Lot No. 16, Final Subdivision Plan - Section No. 1, The Villas Estates, prepared by John K. Bixler, III, Professional Land Surveying Services, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 70, Page 46-A, et seq. HAVING THEREON ERECTED a two-story dwelling house known and numbered as 31 Essex Drive, Drive, Carlisle, Pennsylvania 17013. UNDER AND SUBJECT to Declaration of Protective Covenants, Restrictions, and Conditions, Villas Estates, Phase I, dated the 12th day of July, 1996, and recorded July 16, 1996, in the Office of the Recorder of Deeds, Cumberland County, Pennsylvania, Miscellaneous Book 525, Page 301, and FURTHER UNDER AND SUBJECT to easements, restrictions, reservations, conditions, and rights-of-way of record and as shown on the above-mentioned Plan of Lots. NOW, the day of ,2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said GLEN A. BANNON and MILDRED M. BANNON, to the said FINE LINE HOMES, INC. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with FINE LINE HOMES, INC. and the further consideration of One Dollar, to FINE LINE HOMES, INC. paid by GLEN A. BANNON and MILDRED M. BANNON, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
