Plaintiff, CHASE BANK USA, N.A. , is a corpoll ation located in ATLANTA, GA 2. Defendant is adult individual(s) residing at the address listed below: MARLYNN A MEYER 49 WESTWOOD CT ENOLA, PA 17025 3. Plaintiff and Defendant entered into a r Agreement for a credit card bearing the account number 441712607147396 . A true and correct copy of the Cardmember Agreement is atta hed hereto, marked as Exhibit "1" and made a part hereof. 4. This account was subsequently assigned to Plaintiff for value. 5. The Cardholder Agreement contains a provisio to settle by arbitration any claim, dispute or controversy ar sing from or relating in any way to the Cardholder Agreement. 6. Defendant made use of said credit card and due and owing to Plaintiff, as of May 08, 2006 , currently a balance in the amount of $8934.65 7. Defendant failed to include any New Matter in her pleading, and therefore under Pennsylvania Rule of Civil Procedure No. 1032(a): "a party waives all defenses and objections which are not presented either by preliminary objection, answer or reply..." 4. On or about September 6, 2006 Plaintiff provided Requests for Admissions to Defendant and received no responses thereto (See: Exhibit "A", attached hereto and incorporated by reference herein). 5. Pursuant to Pennsylvania Rule of Civil Procedure No. 4014(b), the failure of Defendant to respond to the Requests for Admission thereby result in admissions to the matters therein. 6. Defendant has therefore admitted applying for the credit card, using the credit card for purchases of goods, materials and services, failing to make payments under the credit card agreement from on or about October 9, 2004, admitted not submitting any written dispute of any billing inaccuracy, admitted the accuracy of credit card statements attached as an Exhibit to the requests for admission, admitted the accuracy of finance charges and has admitted the accuracy of the balance as claimed in the Complaint as due and owing. 7. As'. there is no genuine issue of fact as to a necessary element of Plaintiff's cause of action or a `defense thereto that could be established by additional discovery or expert report by Defendant, and Plaintiff is entitled to judgment in its favor as a matter of law.
