STIPULATION AGAINST LIENS
WHEREAS, McCormick Crossing, a Pennsylvan a General Partnership of
Pennsylvania is about to execute contemporaneously herewith, a conn act with Wheatland Custom
Homes, Inc., a Pennsylvania Corporation of Lancaster County, Penns Ivania, for the erection of a
dwelling upon a lot ofland situate as follows:
ALL THAT CERTAIN tract of land, situate in the T wnship of Monroe, County
of Cumberland, and Commonwealth of Pennsylvania, being known as Lot No. 32 on Subdivision
Plan of Duffield Crossing, Phase III and being more fully described in lIe legal description attached
hereto and made a part hereof as Exhibit "A".
NOW,the 7 _~+J.-. dayof 1.(Y:/ , 2006, a the time of and immediately
before the execution of the principal contract, d before any authorit has been given by the said
McCormick Crossing, a Pennsylvania General Partnership, to the said Wheatland Custom Homes,
Inc. to commence work on the said building, or purchase materials fi r the same in consideration
of the making of the said contract with Wheatland Custom Homes, Inc. md the further consideration
of One Dollar, to Wheatland Custom Homes, Inc. paid by McCormi k Crossing, a Pennsylvania
General Partnership, it is agreed that no lien shall be filed against the t uilding by the contractor, or

any sub-contractor, nor by any of the material men or workmen or an other person for any labor,
or materials purchased, or extra labor or materials purchased for the rection of said building, the
right to file such liens being expressly waived.

ALL THAT CERTAIN tract of land, situate in the Township ofMo oe, County of
Cumberland, and Commonwealth of Pennsylvania, being more partic larly bounded and
described as follows, to wit:
BEGINNING at a point on the eastern right-of-way line of Lucinda ane at the comer of Lot
No. 32 and Lot No. 19, Phase II as shown on the hereinafter mention plan ofIots; thence along
said right-of-way line by a curve to the left having a radius of225.00 eet and an arc length of
20.403 feet to a point; thence continuing along said right-of-way line fLucinda Lane North 76
degrees 19 minutes 51 seconds East, a distance of 181.078 feet to a pint at the dividing line
between Lot No. 31 and Lot No. 32; thence along said dividing line S uth 12 degrees 22 minutes
31 seconds East, a distance of 259.629 feet to a point; thence continui g South 11 degrees 10
minutes 50 seconds East, a distance of 143.347 feet to a point; thence South 86 degrees 40
minutes 24 seconds West, a distance of 340.503 feet to a point at the ividing line between Lot
No. 32 and Lot No. 19, Phase II; thence along said dividing line No 17 degrees 32 minutes 41
seconds East, a distance of385.192 feet to a point, said point being th Place of BEGINNING.
BEING Lot No. 32 on Subdivision Plan of Duffield Crossing, Phase III recorded December 14,
2001 in the Office of the Recorder of Deeds in and for Cumberland C unty, Pennsylvania in Plan
Book 84, Page 78.
BEING PART OF THE SAME PREMISES Harry H. Fox, Jr., am' ed man, by his deed
dated July 9,1999 and recorded July 16, 1999 in the Office of the Re order of Deeds in and for
Cumberland County, Pennsylvania in Deed Book 203, Page 1058, gr ted and conveyed unto
McCormick Crossing, a Pennsylvania General Partnership, GRANT R herein.
UNDER AND SUBJECT to Declaration of Restrictive Covenants re orded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania in iscellaneous Book 683,
Page 461.
UNDER AND SUBJECT to setbacks, easements, rights-of-way, co itions and restrictions as
shown on the above plan of record,
