The name and address of the Owner or Reputed Owner (" wner") subject to the lien is MNR Enterprises, Inc. d/b/a The Original Soup Man, a Pe sylvania business corporation with a registered address of 1840 Sapling Co , Mechanicsburg, Cumberland County, Pennsylvania. 3. The date on which Claimant completed the work for whic this claim is made is on or about February 3, 2006. 4. The Claimant contracted with the Owner to install a pre-as emb1ed restaurant kiosk known as "The Original Soup Man" which kiosk is known and numbered as Kiosk #1 and is located in the Capital City Mall Food Court, 3506 C pital City Mall Drive, Camp Hill, Cumberland County, Pennsylvania. A copy of the 'tten contract is attached hereto as Exhibit "A" and is incorporated herein by refere ceo Copies of the accepted change orders to the contract are collectively attached her to as Exhibit "B" and are incorporated herein by reference. 5. The unpaid balance due Claimant on the contract and accejpted change orders is $19,000 , i plus interest at one and one-half percent (1.50%) monthly n the unpaid balance from the date of the completion of services. 6. The lien is claimed against the ownership interest of the 0 er or Reputed Owner in the aforesaid Kiosk #1,3506 Capital City Mall, Camp Hill, C berland County, Pennsylvania. WHEREFORE, Claimant, Mass Construction Group, Inc., claims to have a lien upon the premises hereinabove described in the amount of$19,000, plus interest a a rate of 1.50% per month, costs and other amounts permitted by law against Owners or Reputed 0 ers and the premises. Owners are the alleged owners of a moveable kiosk at an enclosed mall called the Capital City Mall (hereinafter "Mall"), owned by the Capital City Limited Partnership Pennsylvania Real Estate Investment Trust. 2. The Defendant alleges to have perfonned certain work in that it assembled a moveable kiosk in the Mall. 3. On or about May 31,2006, the Claimant filed a Mechanic's Lien against the Owners. A true and correct copy is attached hereto as Exhibit "A". 4. However, the Claimant has failed altogether to properly identify the owner of the land, i.e, the Capital City Mall. Further, the Claimant has failed to allege that notice was provided to the owner of the Mall. 5. Failure to correctly identify the owner of property is a fatal defect and renders mechanics' lien invalid. Delmont Mechanical Services. Inc.. v. Kenver C011>.. 450 Pa.Super. 666, 677 A.2d 1241 (1996). 6. Further, Under 49 P.S. ~1303(d), no lien maybe had against the owner ofland for work performed on behalf of a tenant unless it can be shown that the construction, erection, alteration or repair is for the immediate use and benefit of the owner. Chambers v. Todd Steel Picklin~. Inc. 323 Pa.Super. 119,470 A.2d 159 (1982). 7. Clearly, the Mall is owned by another party and the Claimant has not alleged that the work was for the immediate benefit of the Capital City Limited Partnership Pennsylvania Real Estate Investment Trust. OBJECT IS NOT PROPERTY UNDER THE THE MECHANIC'S LIEN LAW, 49 P.S. ~ 1502 8. Plaintiff incorporates by reference hereto the allegations of paragraphs I through 7 as if the same were more fully set forth here at length. 9. The Claimant alleges that he assembled a restaurant kiosk on behalf of the Owners. However, such activity is not considered an improvement and/or alteration to land. 10. The Claimant has not identified the work performed as erection, construction, alteration or repair ofland. 11. It is essential for a Mechanic's Lien claim, that the work performed consist of either erection/construction and/or alteration/repair to land. Here, the Claimant simply assembled a moveable kiosk in the Mall. MECHANIC'S LIEN NOT PERMITTED UNDER CONTRACT 12. Plaintiff incorporates by reference hereto the allegations of paragraphs I through II as if the same were more fully set forth here at length. 13. The Claimant attaches to the Mechanic's Lien a copy of the contract allegedly entered into between the Owner and Claimant. 14. However, Claimant only attached portions of the Contract in question. Specifically, the contract references and makes part the General Terms of AIA 1997 edition ofthe Standard Form of Agreement Between Owner and Contractor, AIA Document AIOI- 1997 and A-201-1997. 15. Specifically, Section 4.5 "MEDIATION", 4.5.1., states "Any claim arising out of or related to the Contract, except Claims related to aesthetic effect and except those waived as provided for in Subparagraphs 4.3.10,9.10.4 and 9.10.5, shall, after initial decision by the Architect or 30 days after submission of the claim to the Architect, be subject as a condition precedent to arbitration or the institution oflegal or equitable proceedings by either party." 16. The Contract continues by stating under Section 4.6 "ARBITRATION", 4.6.1, "Any Claim arising out of or related to the Contract, except Claims relating to aesthetic effect and except those waived as provided for in Subparagraphs 4.3.10,9.10.4 and 9.10.5, shall, after decision by the Architect or 30 days after submission of the Claim to the Architect, be subject to arbitration. Prior to arbitration, the parties shall endeavor to resolve disputes by mediation in accordance with the provisions of Paragraph 4.5. 17. Finally, Section 4.6.6., "Judgment on Final Award", states, "The award rendered by the arbitrator or arbitrators shall be final, and judgment may be entered upon it in accordance with applicable law in any court having jurisdiction thereof. 18. It is clear that the Contract at issue call for and mandates all disputes to be fIrst sent to mediation and then fInally decided by arbitration. It is essential therefore that the parties be bound by the tenns of the Contract. As a result, the mechanic's lien, must be dismissed with prejudice.
