On or before MARCH 27, 2003, Plaintiff and Defendant entered into a Cardmember Agreement for a credit card bearing the account number 4417129508158153 . A true and correct copy of the Cardmember Agreement is attached hereto, marked as Exhibit "I" a d made a part hereof. 4. This account was subsequently assigned to Plaintiff for va ue. 5. The Cardholder Agreement contains a provision to se le by arbitration any claim, dispute or controversy arising from or relating in any way to the Cardhold r Agreement. W WR No. 05155998 V 6. Plaintiff, as of May 11, 2006, in the amount of $ 1,573.23 . 7. Defendant is in default of the term's of the cardholder Agreement having not made monthly payments to Plaintiff thereby rendering the entire balance immediately due and payable. 8. Plaintiff avers that the Cardholder Agreement betwe n the parties provides that Plaintiff is entitled to the addition of finance charges at the rate of 6.?% per annum on the unpaid balance. 9. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and/or refused to pay the principal balance, finance charges or any part th?reof to Plaintiff.
