Carter, by and through her attorneys Saidis, Flower & Lindsay, PC commence this action for money judgment for failure to enter satisfaction of a mortgage payment after request for satisfaction was made in accordance with the statutory authorization of the Mortgage Satisfaction Act 21 P.S. ~ 721-6 et sea. and in support thereof aver as follows: I. Plaintiff, Kimberly S. Carter (the "Mortgagor"), is a married individual residing at 1878 Douglas Drive, Carlisle, Cumberland County, Pennsylvania. 2. Defendant, GMAC Mortgage Corporation d/b/a ditech.com, is a California business corporation engaged in the mortgage business, having its principle place of business as 3200 Park Center Drive, Suite 150, Costa Mesa, California 92626. 3. Plaintiff signed a mortgage dated May 3, 2000 and recorded June 1,2000 in the Recorder of Deed's Office in and for Cumberland County, PA in Mortgage Book 1615, Page 852, a copy of which is attached hereto, made a part hereof and marked Exhibit "A" which encumbered 17 Hilltop Lane, West Pennsboro Township, Cumberland County, Pennsylvania (the "Property"). 4. On June 18, 2004, Plaintiff sold the Property to Barry L. Shughart and Susan L. Shughart, a true and correct copy of the settlement sheet from the transaction is attached hereto, made a part hereof and marked Exhibit "B". On or about June 18,2004, Plaintiff sent the payment required by Defendant of $37,346.51 for "full satisfaction of the current debt and . . . release of the lien of the subject property. . .". A copy of the Defendant's statement concerning the release of the Mortgage is attached hereto, made a part hereof and marked Exhibit "C". 6. Plaintiff forwarded the required payment of$37,346.51. which was received by the Defendant on June 21, 2004 together with Notice to Record Mortgage Satisfaction Piece To Avoid Penalty, a copy of which is attached hereto, made a part hereof and marked Exhibit "D". 7. Defendant failed to comply with the provisions of the Mortgage Satisfaction Act, which requires the Defendant satisfy the Mortgage within Sixty (60) days of the required notice to satisfy receipt. 8. Despite repeated demands, Defendant has continued to refuse to satisfy the Mortgage. WHEREFORE, the Plaintiff respectfully request that Your Honorable Court enter judgment in her favor and against the Defendant and award her money damages in an amount not to exceed ($40,000.00) Forty Thousand Dollars pursuant to the Mortgage Satisfaction Act, plus costs of suit, attorney's fees and any other relief this Honorable Court deems appropriate.
