THIS AGREEMENT made the ~fM of April, 2002, by and
between S & A CUSTOM BUILT HOMES, INC., Contractor,
JACK E. FAIRES AND MARY LOU E. FAIRES, husband and wife,
hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a single family dwelling on
that certain lot of ground situate in
South Middleton Township, Cumberland County, Pennsylvania, more
particularly described in attached Exhibit "A", also referred to
as 11 Meadowood Place, Boiling Springs, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSE'£~: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to S & A Custom Built Homes, Inc. in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting
through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of
them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished
by them or any of them under said contract or otherwise, for,
towards, in, or about the erection and construction of the said
buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract of land situated in South Middleton
Township, Cumberland County, PA, being Lot No. 11, as shown on a
Plan entitled, "Final Subdivision Plan, Meadowood Site Plan",
dated February 9, 2000, by Advantage Engineering Services, Inc.,
Harrisburg, PA, being bounded and described as follows:
BEGINNING at an iron pin, being a southerly corner of Lot No.
10, and lying in a westerly R/W line of Meadowood Place; thence
along said R/W, along a curve to the left, having a radius of
60.00 feet, an arc length of 51.02 feet, a delta angle of 48
degrees 43' 24", a tangent of 27.17 feet to an iron pin, lying
along said R/W, and being a northerly corner of Lot No. 12;
thence along said Lot, S 42 degrees 46' 40" W, 318.01 feet to an
iron pin, being a westerly corner of said Lot and lying in an
easterly line of lands owned now or formerly by Buscher, (D.B.
178, Pg. 1041); thence along said lands, N 14 degrees 52' 44" W,
97.19 feet to an iron pin; thence continuing along said lands, S
80 degrees 46' 46" W, 158.01 feet to a corner post found, lying
along said lands and being an easterly corner of lands owned now
or formerly by Fay (D. B. 36-N, Pg. 813); thence along said
lands, N 16 degrees 30' 00" W, 231.58 feet to an iron pin, lying
along said lands and being a southerly corner of Lot No. 10;
thence along said Lot, S 88 degrees 29' 56" E, 443.60 feet to an
iron pin, being the place of BEGINNING.
CONTAINING 80,192.18 square feet.
BEING PART OF THE SAME PREMISES which Sally A. Kreitzer and
Richard L. Kreitzer, her husband; Keith D. Stought and Connie L.
Stought, his wife; Lynn Ellen Stought, single woman; and Diane
Lee Stought, single woman, tenants in common, by Deed dated May
25, 1999 and recorded June 2, 1999 in the Office of the Recorder
of Deeds in and for Cumberland County, Pennsylvania, in Deed Book
200, Page 887, granted and conveyed unto S&A Custom Built Homes,
Inc.
