PHILLIPS, Petitioner ORPHANS' COURT DIVISION v. : NO. 21-06-0122 ROBERT G. FREY, Respondent ORDER AND DECREE AND NOW this !.~ day of June, 2006, the following is hereby an Order of Court: 1. Alice R Phillips may continue to reside on the premises (defined as the "Homestead") pending adjudication of the claims as outlined in the attached tax map of the Estate's real property set forth as Exhibit "A" ("Tax Map"). Alice R. Phillips or her immediate family or persons employed by her shall not enter any property other than the Homestead outside the natural boundary of the residence as previously agreed with the Executor of the Estate, Robert G. Frey on the Tax Map. Provided, however, that security personnel employed by Alice R. Phillips shall be permitted in areas outside of the Homestead if they reasonably believe unauthorized persons may be on other portions of the property. 2. The children of the Decedent, specifica1]y, Linwood B. Phillips, III, Merle R. Phillips, W. Alan Phillips and Linda L. Stull are enjoined from accessing the following properties as identified on the Tax Map: the Homestead and the area JUN-14-2005 14:25 P.03 directly adjacent to the north and south of the Homestead which shall be called the "Neutral Zone". The Neutral Zone will continue to serve until a hearing is held as an area of which neither party will access, provided however, Linda 1. Stull shall be permitted to access the Neutral Zone for purposes of egress and ingress for purposes of maintaining the froms and properties related to the businesses directly behind the Homestead. 3. Linwood B. Phillips, III, Merle R. Phillips, W. Alan Phillips and Linda L. Stull and their immediate family (which is limited to their children) shall be permitted to access the balance ofthe contiguous property to the Neutral Zone (including specifically the Camp Ground), provided however, at no time may any of their children (i.e., the Decedent's grandchildren) be on the surrounding estate property unless accompanied by Linwood B. Phillips, III) Merle R. Phillips, W. Alan Phillips and Linda L. Stull. Any other individuals shall be considered trespassing and in direct violation ofthi5 Order and subject to an'est. As an example of the aforementioned, if a grandchild of the Decedent is on the Camp Ground (or any other Estate property) without the company of one of the aforementioned children of the Decedent, he or she will be in direct violation of this Order and subject to the charge of trespass. 4. Furthermore, Alice R. Phillips, Linwood B. Phillips, III, Merle R. Phillips, W. Alan Phillips and Linda L Stull and their immediate family shall not by any means of communications device make, create, or initiate the transmission of any comment, request, suggestion, proposal, image, or other communication which is JUN-14-2006 14:25 P.04 obscene, lewd, lascivious, filthy, or indecent, with intent to annoy, abuse, threaten, or harass either party. 5. Alice R. Phillips, Linwood B. Phillips, III, Merle R. Phillips, W. Alan Phillips and Linda L. Stull and their immediate family and persons employed by any of them shall not by any means use any optical surveillance device (whether covel1 or not), including without limitation intended, the use of binoculars or telescopes, in a secretive, continuous or periodic observation of the other whether or not then recorded in a material form.
