COMPLAINT
1. Plaintiff Partners Trust Bank, successor by merger to BSB Bank & Trust is a New
York State chartered bank having a place of business at 58-68 Exchange Street, Binghamton,
New York, 13902.
2. Defendants, Curtis C. Miller, Jr. and Toni J. Miller are adult individuals with a
last known address of 1550 Williams Grove Road, Lot 126, Mechanicsburg, Cumberland
County, Pennsylvania 17055.
3. On or about May 22, 1998, Defendants entered into a Variable/Simple Interest
Note, Disclosure and Security Agreement (the "Note") with Forward Financial Company of 360
Church Street, Northboro, Massachusetts 01532 for the purchase money financing of a used
1995 Commander 70' x 14' Mobile Home, serial number CT27709A (the "Mobile Home"). A
true and correct copy of the Note is attached hereto as Exhibit "A" and incorporated herein by
reference as if fully set forth.
4. By Assignment dated May 22, 1998, Forward Financial Company assigned all of
its rights, benefits, title and interest in the Note and Security Agreement to Plaintiff. A true and

correct copy of the Assignment is attached hereto as Exhibit " B" and incorporated herein by
reference as if fully set forth.
Plaintiff's perfected security interest in the Mobile Home is evidenced by a
Commonwealth of Pennsylvania Certificate of Title, a true and correct copy of which is attached
hereto as Exhibit "C" and incorporated herein by reference as if fully set forth.
6. Defendants defaulted under the Note by failing to make monthly payments when
due beginning February 5, 2006 and on the fifth (5th) day of each month thereafter.
Pursuant to the Note, in the event of default, Plaintiff may, and by letter dated
April 12, 2006 did, make unpaid principal, earned interest and other agreed charges owed by
Defendants under the Note immediately due. A true and correct copy of Plaintiff's April 12,
2006 letter is attached hereto as Exhibit "D" and incorporated herein by reference as if fully set
forth.
8. Pursuant to the Note, Plaintiff gave Defendants notice of Plaintiff's intention to
repossess the Mobile Home and an opportunity to cure Defendants' default. See Exhibit "D."
9. As a result of Defendants' default under the Note, Plaintiff is entitled to
immediate possession of the Mobile Home.
10. The present fair market wholesale value of the Mobile Home is approximately
$7,739.65.
11. Defendants are in possession of the Mobile Home at 1550 Williams Grove Road,
Lot 126, Mechanicsburg, Pennsylvania 17055.
WHEREFORE, Plaintiff Partner's Trust Bank, successor by merger to BSB Bank & Trust
demands judgment in replevin against Defendants, Curtis C. Miller, Jr. and Toni J. Miller, for

possession of the Mobile Home, plus costs, special damages thereon in the amount to be
determined, attorneys' fees, and such other relief as this Court deems just.
