That Petitioner resides at 8 E. Pine Street, Enola, Cumberland County, P A 17025. 2. On or about May 6, 2006, Petitioner was alleged to have refused a chemical test in violation of 75 Pa. C.S.A. 91547. 3. On or about May 19, 2006, Petitioner was sent a notice from the Bureau of Motor Vehicles, indicating that his motor vehicle operator's privileges were suspended, effective June 23, 2006 for a one year period for allegedly having violated the referenced statute. A copy of said notice is attached hereto and marked Exhibit "A". 4. That said suspension is on its face improper for several reasons including, but not limited to the fact that the police officer utilized an improper implied consent form which is not legally sufficient to provide the statutorily rnandated warnings regarding a refusal to submit to chemical testing. 5. Moreover, at no time did Petitioner indicate by words or actions that he was refusing chemical testing. 6. That said suspension further constitutes a violation of the Petitioner's rights under other applicable law as well as the Constitutions of the United States and the Commonwealth of Pennsylvania. WHEREFORE, Petitioner requests this Appeal be allowed, that a hearing be granted to determine whether the suspension is valid, that this Appeal act as a supersedeas pending hearing, and that upon conclusion thereof Petitioner's motor vehicle operation privileges be restored. Kabusk, Esquire, respectfully represents as follows: 1. The Department mailed to Michael J. McGarvey a notice dated May 19, 2006, informing him that as a result of his violation of Section 1547 of the Vehicle Code, relating to Chemical Test Refusal, on May 6, 2006, his driving privilege was being suspended for a period of one year. 2. Mr. McGarvey filed an appeal of the above mentioned suspension in the Court of Common Pleas of Cumberland County. 3. A hearing in the rnatter has been set for August 30, 2006, at 1 :30 p.m. in the Courthouse in Cumberland County, Carlisle, Pennsylvania. 4. The refusal was reported to the Department of Transportation by Officer Frank Galbraith who is employed as a police officer by the Collingdaie Police Department. See Exhibit 1. 5. Delaware County is the location where the arrest for a violation of 75 Pa. CoSo ~ 3802 (relating to driving under influence of alcohol or controlled substance) and the violation of Section 1547 of the Vehicle Code occurred. 6. Section 933 of the Judicial Code states that the venue shall be in the county where the arrest for a violation of 75 Pa. C.S. ~ 3802 (relating to driving under influence of alcohol or controlled substance) was rnade in appeals involving the suspension of operating privileges under 75 Pa. C.S. ~ 1547 (relating to chemical testing to determine amount of alcohol or controlled substance) or the residence of any individual appellant where the venue is not otherwise fixed by this sentence. 42 Pa. C.S. ~ 933. See Pass v. Commwo of Penna. Dept. of Trans. Bureau of Driver Licensing, 804 A.2d 77 (Pa. Cmwlth. 2002)0 7. The proper venue for this matter is in the Court of Common Pleas of Delaware County. 80 The motorist's operating privilege has been restored pending appeal pursuant to Section 1550 of the Vehicle Code. 90 The undersigned contacted Timothy P.
