WHEREAS, Christopher Notarfrancesco and Elizabeth P. Notarfrancesco, of 524
Grandview Avenue, Camp Hill, PA 17011, Cumberland County, Pennsylvania is about to execute
contemporaneously herewith, a contract, with Farinelli Construction, Inc., of 3 Kacey Court,
Mechanicsburg, PA 17055, Cumberland County, PA, for the erection of a single family dwelling
upon a lot of land situate in Upper Allen Township, Cumberland County, (See Exhibit A).
Now, March 19th, 2002 at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said owner to the said contractor to
commence work on the said building, or purchase materials for the same in consideration of the
making of the said contract with and the further consideration of One Dollar, to paid by, it is
agreed that no lien shall be filed against the building by the contractor, or any sub-contractor. Nor
by any of the material men or workmen or any other person for any labor, or materials purchased,
or extra labor or materials purchased for the erection of said building, the right to file such liens
being expressly waived.

EXHIBIT A
ALL THAT CERTAIN tract or parcel of land situate in the Township of
Upper Allen, Cumberland County, Pennsylvania, more particularly bounded
and described as follows, to wit:
BEGINNING at a point in the northerly right-of-way line of Brookwood
Drive at the dividing line between the premises herein described and Lot
No. 16 on the hereinafter mentioned Plan of Lots; thence along said
right-of-way line South eighty-seven (87) degrees forty-six (46) minutes
West, a distance of twenty (20) feet to a point at which is located a
concrete monument; thence along said right-of-way line along the arc of
a curve to the right which curve has a radius of one hundred fifty-five
(155) feet an arc distance of two hundred fourteen and seventy-one one
hundredths (214.71) feet to a point at which is located a concrete
monument; thence along said right-of-way line North twelve (12) degrees
fifty-two (52) minutes West, a distance of twenty-four and forty-five
one hundredths (24.45) feet to a point at which is located a concrete
monument; thence along said right-of-way line along the arc of a curve
to the left which curve has a radius of one hundred twenty-eight and
twenty-two one hundredths (128.22) feet, an arc distance of ninety and
eighty-six one hundredths (90.86) feet to a point; thence along said
right-of-way line and the easterly right-of-way line of Arcona Road (LR
21093) along the arc of a curve to the right which curve has a radius of
forty (40) feet, an arc distance of fifty-three and twenty-three one
hundredths (53.23) feet to a point; thence continuing along said
right-of-way line of Arcona Road North twenty-two (22) degrees forty-six
(46) minutes thirty (30) seconds East, a distance of nine and
seventy-four one hundredths (9.74) feet to a point; thence continuing
along said right-of-way line North fourteen (14) degrees thirty-one (31)
minutes East, a distance of five hundred twenty-three and seventy-one
one hundredths (523.71) feet to a point at which is located a concrete
monument; thence along the line of lands now or formerly of Thelma D.
Armstrong, et al South seventy-three (73) degrees nine (9) minutes East,
a distance of one hundred eight and fifty one hundredths (108.50) feet
to a point at which is located a concrete monument; thence continuing
along the said line of lands North fourteen (14) degrees thirty-one (31)
minutes East, a distance of one hundred twenty-five (125) feet to a
point at which is located a concrete monument; thence continuing along
the line of said lands North eighty-eight (88) degrees eight (8) minutes
East, a distance of one hundred eighty-nine and ninety-five one
hundredths (189.95) feet to a point; thence along the dividing line
first above mentioned South thirteen (13) degrees forty-nine (49)
minutes West, a distance of nine hundred three and thirty-seven one
hundredths (903.37) feet to a point, the point and Place of BEGINNING.
BEING Lot No. 17, Plan of Arcona Estates, Phase I, which Plan is
recorded in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania, in Plan Book 41, Page 27.
