COMPLAINT IN MORTGAGE FORECLOSURE
Plaintiff is COUNTRYWIDE HOME LOANS INC., 7105 Corporate Drive, PTX B-35 Plano, TX
75024-3632.
2. The name and address of the Defendant is DENISE D. BEARD, 422 West Shady Lane, Enola, PA
17025-2241, who is the mortgagor and real owner of the mortgaged premises hereinafter described.
On August 26, 2004 mortgagor made, executed and delivered a mortgage upon the premises hereinafter
described to COUNTRYWIDE HOME LOANS, INC., which mortgage is recorded in the Office of the
Recorder of Deeds of Cumberland County as Book 1878, Page 4255. The Mortgage and assignment(s)
are matters of public record and are incorporated by this reference in accordance with Pennsylvania Rule
of Civil Procedure 1019(g); which Rule relieves the Plaintiff from its obligation to attach documents to
pleadings if those documents are matters of public record.
4. The Property subject to the Mortgage is more fully described in the legal description set forth as Exhibit
"A" ("Property").
5. The mortgage is in default because the monthly payments of principal and interest are due and unpaid
for July 01, 2005, and each month thereafter and by the terms of the Mortgage, upon default in such
payments for a period of one month, the entire principal balance and all interest due and other charges
are due and collectible.
6. The following amounts are due to Plaintiff on the Mortgage:

If the Mortgage is reinstated prior to a Sheriff's Sale, the Attorney's Fees set forth above may be less
than the amount demanded based on work actually performed. The Attorney's Fees requested are in
conformity with the Mortgage and Pennsylvania law. Plaintiff reserves its right to collect Attorney's
fees of up to 5% of the remaining principal balance in the event the Property is sold to a third party
purchaser at Sheriff s Sale or if the complexity of the action requires additional fees in excess of the
amount demanded in the Action.
8. Plaintiff is not seeking a judgment of personal liability (or and "in person am' judgment) against the
Defendant in this Action but reserves it's right to bring a separate Action to establish that right, if such
right exists. If Defendant has received a discharge of their personal liability in a Bankruptcy proceeding,
this Action of Mortgage Foreclosure is, in no way, an attempt to re-establish the personal liability that
was discharged in Bankruptcy, but only to foreclose the Mortgage and sell the Property pursuant to
Pennsylvania law.
9. Notice of Intention to Foreclose and a Notice of Homeowners' Emergency Mortgage Assistance has
been sent to Defendant by certified and regular mail, as required by Act 160 of 1998 of the
Commonwealth of Pennsylvania, on the date(s) set forth in the true and correct copy of such notice(s)
attached hereto as Exhibit "B". The Defendant has not had the required face-to-face meeting within the
required time and Plaintiff has no knowledge of any such meeting being requested by the Defendant
through the Plaintiff, the Pennsylvania Housing Finance Agency, or any appropriate Consumer Credit
Counseling Agency.
WHEREFORE, Plaintiff demands a de terris judgment in mortgage foreclosure in the sum of $106,419.77,
together with interest at the rate of $18.41, per day and other expenses costs and charges incurred by the
Plaintiff which are properly chargeable in accordance with the terms of the Mortgage and Pennsylvania law
until the Mortgage is paid in full, and for the foreclosure of the Mortgage and Sheriff's Sale of the Property.

PETITION TO SET ASIDE A SHERIFF'S SALE
The petition of DENISE D. BEARD represents as follows:
1. Denise D. Beard is an adult individual residing at 422 West Shady Lane, Enola, PA
17025.
2. Countrywide Home Loans, Inc., holds a first mortgage on the above referenced property
and the address of Countrywide Home Loans, Inc. is 7105 Corporate Drive PTX-B-35,
Plano, TX 75024.
• Countrywide Home Loans, Inc., at all times relevant herein, has been represented
by Attorney Joseph A. Goldbeck, Jr., 701 Market Street, Philadelphia, PA 19106.
Attorney Goldbeck's telephone number is (215) 627-1322.
3. Denise D. Beard filed for relief under Chapter 13 of the Bankruptcy Code on or about
December 2, 2006.
4. The purpose of the filing of the Chapter 13 was to prevent a Sheriffs Sale from
happening against her real estate. This sale was initially set for December 6, 2006 by the
Office of the Sheriff in and for Cumberland County, Pennsylvania.
5. The petition was filed in good faith; the December 6, 2006 Sheriffs Sale was cancelled
and did not occur.
6. Unknown to Denise D. Beard, and without notice to her individually or her legal counsel
of record, and without posting the property in any way, the mortgage company caused the
sale of her property to occur on February 7, 2007. The mortgage company purchased the
real estate for $1.00 and the amount of their mortgage lien. The real estate purchased is
known and numbered as 422 West Shady Lane, Enola, PA 17025.
7. The sale of Denise D. Beard's property without notice of any nature or sort to her or her
legal counsel of record vitiates the legitimacy and legality of the Sheriff's Sale.
8. Denise D. Beard did list this property for sale and a contract for sale has been executed.
This contract is marked as Exhibit "A".
9. Denise D. Beard will have a final closing and/or settlement on this real estate, the subject
matter of this petition, on February 23, 2007, at which time Countrywide Home Loans,
Inc. will be paid in full the obligation due and owing to them on account of their
mortgage.
10. In addition to full payment of the mortgage to Countrywide, there will be proceeds in
excess of expenses that would lawfully go to Denise D. Beard in the approximate amount
of $14,255.00. See Exhibit "B".
11. This lack of notice of any nature or sort, posting, letter or otherwise, violates the law and
is certainly prejudicial to the plaintiff.
WHEREFORE, plaintiff respectfully prays that this honorable court set aside the Sheriffs Sale
of the property known and numbered as 422 West Shady Lane, Enola, PA 17025 that occurred
on February 7, 2007 to Countrywide Home Loans, Inc. and declare this property to be the
property of Denise D. Beard.

Plaintiff, Countrywide Home Loans, Inc. ("Plaintiff'), by and through its
undersigned counsel, hereby responds to the Petition to Set Aside Sheriffs Sale of
defendant, Denise D. Beard ("Defendant"), as follows:
1. Admitted.

4. Plaintiff is without information as to why Defendant filed for bankruptcy
protection. It is admitted that the subject property was originally listed to be sold at the
December 6, 2006 Sheriffs sale.
5. Denied. The averment in paragraph five (5) regarding good faith is
a conclusion of law to which no responsive pleading is required. It is denied that the
Sheriff s sale was canceled. Rather, Plaintiff postponed the sale to February 7, 2007
pursuant to Pa. R.C.P. No. 3129.3(b).
6. Denied as characterized. Pursuant to Rule 3129.3(b), if a Sheriffs
Sale of a property is postponed to a date certain within one hundred days, and public
announcement thereof is made, then no new notice is required. In the present case, the
Sheriff s sale of the subject property was postponed to February 7, 2007, which is 63
days from the date of the original sale. As such, no new notice was required.
Nonetheless, on December 5, 2006, Plaintiff's counsel's office sent an e-mail to
Defendant's counsel advising Defendant's counsel of the postponement. This notice was
also mailed to Defendant. A true and correct copy of the e-mail is attached hereto and
marked as Exhibit A. It is admitted that Plaintiff purchased the subject property for $1.00
at the February 7, 2007 Sheriff's sale.
7. Denied. The averments in paragraph seven (7) are conclusions of
law to which no response is necessary. By way of further response, Plaintiff complied
with all applicable notice rules, and the Sheriff's sale of the subject property was properly
held.
8. The averments of paragraph eight (8) refer to a document which is in
writing and speaks for itself. Any characterization thereof is therefore denied.
9. Denied. Plaintiff is without sufficient knowledge, information or
belief to form an opinion to the truth or falsity of the averments of paragraph nine (9)
and, as such, the same are denied. By way of further response, Defendant no longer owns
the subject property, and thus cannot sell the subject property.
10. Plaintiff is without sufficient knowledge, information or belief to form an
opinion to the truth or falsity of the averments of paragraph ten (10) and, as such, the
same are denied.

TO DEFENDANT'S PETITION TO SET ASIDE SHERIFF'S SALE
1. FACTS
Plaintiff filed its Complaint in mortgage foreclosure on June 20, 2006. Due to
Defendant's failure to file a responsive pleading, a default judgment was entered against her
on July 28, 2006. Plaintiff also filed a writ of execution and scheduled the property for the
December 6, 2006 Cumberland County Sheriff s sale. Defendant filed for bankruptcy
protection on December 2, 2006, and the Sheriffs sale was postponed to February 7, 2007.
Bankruptcy relief was granted on January 25, 2007. As a result, the subject property was sold
at the February 7, 2007 Sheriff s sale.
II. ARGUMENT
Defendant alleges that the Sheriff s sale should be set aside because she was not properly
notified that the Sheriffs sale was postponed to February 7, 2007. Pursuant to Rule 3129.3(b), if
a Sheriffs Sale of a property is postponed to a date certain within one hundred days, and public
announcement thereof is made, then no new notice is required. In the present case, the Sheriff s
sale of the subject property was postponed to February 7, 2007, which is 63 days from the date of
the original sale. As such, no new notice was required. Nonetheless, on December 5, 2006,
Plaintiffs counsel's office sent an e-mail to Defendant's counsel advising Defendant's counsel
of the postponement. This notice was also mailed to Defendant. A true and correct copy of the
e-mail is attached hereto and marked as Exhibit A.
III. CONCLUSION
For the reasons stated above, Plaintiff respectfully requests that this Honorable Court
deny Defendant's Petition.

enforce the court judgment of $107,092.95 obtained by COUNTRYWIDE HOME LOANS INC. against
you.
NOTICE OF OWNER'S RIGHTS
YOU MAY BE ABLE TO PREVENT THIS SHERIFF'S SALE
To prevent this Sheriffs Sale you must take immediate action:
1. The sale will be cancelled if you pay to COUNTRYWIDE HOME LOANS INC., the back
payments, late charges, costs and reasonable attorney's fees due. To find out how much you must pay call:

2. You may be able to stop the sale by filing a petition asking the Court to strike or open judgment, if
the judgment was improperly entered. You may also ask the Court to postpone the sale for good cause.

EVEN IF THE SHERIFF'S SALE DOES NOT TAKE PLACE.
1. If the Sheriffs Sale is not stopped, your property will be sold to the highest bidder. You may find
out the price bid price by calling the Sheriff of 717-240-6390.
2. You may be able to petition the Court to set aside the sale if the bid price was grossly inadequate
compared to the value of your property.
3. The sale will go through only if the buyer pays the Sheriff the full amount due in the sale. To find
out if this has happened, you may call the Sheriff of 717-240-6390.
4. If the amount due from the Buyer is not paid to the Sheriff, you will remain the owner of the
property as if the sale never happened.
5. You have a right to remain in the property until the full amount due is paid to the Sheriff and the
Sheriff gives a deed to the buyer. At that time, the buyer may bring legal proceedings to evict you.
6. You may be entitled to a share of the money which was paid for your house. A schedule of
distribution of the money bid for your house will be filed by the Sheriff within thirty (30) days from the
date of the Sheriffs Sale. This schedule will state who will be receiving that money. The money will be
paid out in accordance with this schedule unless exceptions (reasons why the proposed distribution is
wrong) are filed with the Sheriff within ten (10) days after the schedule of distribution is filed.
7. You may also have other rights and defenses, or ways of getting your house back, if you act
immediately after the sale.
