WHEREAS, GLENN W. ZEHNER and MARSHAL. ZEHNER of 3 Charisma Drive, Camp
Hill, Pennsylvania, is about to execute contemporan~usly herewith, a contract, with CARLSON
CONSTRUCTION of ~0~ Coo~.,.l C_~o ~d.,C_~x? ~cd~ , Pennsylvania,
for the erection of a building upon premises ~ommonly lm6wn as LOT O-12 CHERISH DRIVE, Township
EAST PENNSBORO, CUMBERLAND County, Pennsylvania, as set forth in the deed dated
~r~ch ~,, ~-oo ~-, recorded at Deed Book __, Page , in the Recorder's Office for
CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is
incorporated herein and attached hereto.
NOW, March 20, 2002, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL TItAT CERTAIN piece or parcel of land situate in East Pennsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the eastern right-of-way line of Cherish Drive, at the common
boundary line of Lot Nos. O-11 and O-12, on the hereinafter mentioned Plan of Lots; thence along said
dividing line South 61 degrees 04 minutes 17 seconds East, 201.65 feet to a point at the line of Lot No.
0-5; thence along same, South 19 degrees 15 minutes 00 seconds West, 27.85 feet to a point; thence along
the common boundary line of Lot Nos. O-13 and O-12, South 86 de~rees 46 minutes 22 seconds West,
198.42 feet to a point at the eastern right-of-way line of Cherish Drive; thence along same by a curve t°
the right having a radius of 250.00 feet, an arc length of 140.31 feet to a point at the soUthwestern line
of Lot No. O-11, the point and place of BEGINNING.
CONTAINING 16,874.79 square feet.
BEING Lot No. O-12 on the Final Plan of Floribunda Heights, Phase II, Section VIII, revised
February 6, 1997 and recorded in the Office of the Recorder of Deeds, Cumberland County, in Plan Book
74, Page 33.
