HomeMy WebLinkAbout02-1361 STIPULATION AGAINST LIENS between J.R. Zeppa Construction, of Lewisberry, Pennsylvania, hereinafter referred to as Contractor, Jolene M. Cocciardi, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a two- story office building on the certain lot of ground situate in Upper Allen Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as 6 Kacey Court, Mechanicsburg, Cumberland County, PA. NOW~'~HEREFORE, THIS AGREEMENT WITNESSETH: That the said Contr~C~t'~'r, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic,s liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. IN WITNESS WHERE(~ I h~t,,,my~~ of~cial seal. ....""~/,~ ~~(, (SEAL) Exhibit "A" ALL that certain lot or parcel of land situate in Upper Allen Township, Cumberland County, Pennsylvania, known as Lot No. 4 as described in Final Subdivision Plan of Chad Hazam, which Plan was recorded in the office of the Recorder of Deeds of Cumberland County, Pennsylvania on February 14, 1990 in Plan Book 60, Page 4, described as follows: BEGINNING at a point on the southern right-of-way line of Kacey Court between Lots No. 4 and No. 3 of the Chad Hazam Subdivision; thence along said right-of-way North 38 degrees 02 minutes O0 seconds West, a distance of 150.00 feet to a point at the common property corner of Lot No. 4 and Lot No. 5; thence along Lot No. 5 South 51 degrees 58 minutes 00 seconds West to a point; thence along lands now or late of Stanley F. Werzyn South 23 degrees 05 minutes 53 seconds East to a point a~:the common property corner of Lots No. 4 and No. 3; thence along Lot No. 3 North 51 degrees 58 minutes 00 seconds East to a point, said point being the place of BEGINNING.
