POLLARD & COMPANY, INC., OWNER, an adult individual with a business address of 11
South Baltimore Street, Dillsburg, Pennsylvania, hereinafter called "Owner" ,and POLLARD &
COMPANY, INC., CONTRACTOR, A Pennsylvania corporation with its principal place of business at
11 South Baltimore Street, Dillsburg, Pennsylvania, hereinafter called "Contractor", have agreed to
erect a single family residential dwelling upon land of Owner situate in Monroe Township, Cumberland
County, Pennsylvania, being more particularly bounded and described on Exhibit "A," attached hereto
and made part hereof.

NOW, this day of June, 2006, before any authority has been given by the said Owner to
the said Contractor to commence work on the said improvements or purchase materials for the same, in
consideration of the making of the said contract with Owner and the further consideration of One Dollar
($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against said property by the
Contractor, or any sub-contractor, nor by any of the material-men or workmen or any other person for
any labor, or materials purchased, or extra labor or materials purchased for the installation and
construction of said municipal improvements, the right to file such liens being expressly waived.

EXHIBIT "A"
ALL THAT CERTAIN tract of land situate in the Township of Monroe, County of
Cumberland, and Commonwealth of Pennsylvania, being more particularly bounded
and described as follows, to wit:
BEGINNING at an iron pin set on the easternmost dedicated right-of-way line of Park
Place (SR. 2008), at the common point of adjoiner of Lots #3 and #4 on the hereinafter
mentioned plan of subdivision; thence extending in and along said dedicated right-of-
way line the following three courses and distances: North twenty-nine degrees forty-four
minutes forty-nine seconds East, for a distance of twenty-five and twenty-four
hundredths feet to a steel pin; thence continuing North twenty-nine degrees forty-nine
minutes twenty-eight seconds East, for a distance of one hundred twenty-three and
eighteen hundredths feet to a steel pin; thence continuing North twenty-nine degrees
fifty-two minutes seven seconds East, for a distance of eighty and one hundredth feet to
a steel pin set on said right-of-way line at Lot #2; thence departing from the Park Place
right-of-way line, and extending along Lot #2, South sixty degrees seven minutes fifty-
three seconds East, for a distance of four hundred fifty-one and forty-six hundredths feet
to a steel pin at lands now or formerly of Donald E. and Marian R. Deckman; thence
extending along said lands, South six degrees fifty-eight minutes forty seconds West,
for a distance of two hundred thirty-six and ninety-two hundredths feet to a steel pin at
Lot #4; thence extending along Lot #4, North sixty-one degrees twelve minutes eleven
seconds West, for a distance of five hundred forty-three and fifty-six hundredths feet to
an iron pin on the easternmost dedicated right-of-way line of Park Place, said pin
marking the place of BEGINNING.
CONTAINING 2.556 acres, and being designated as Lot #3 all in accordance with a
plan of subdivision of Meadows on the Breeches, prepared for Harry H. Fox, Jr. by
Dawood Engineering, Inc., dated September 23, 2004 and recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 90, at
Page 129.
UNDER AND SUBJECT, NEVERTHELESS, to easements and notes set forth on the
above-noted plan of subdivision, and to the Protective Covenants, Restrictions and
Reservations which pertain to the Meadows on the Breeches subdivision, as found of
record in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Miscellaneous Book 719, at page 501.
FURTHER UNDER AND SUBJECT, NEVERTHELESS, to all rights associated with a
cemetery which is situated on the southern side of the within described tract, as well as
access thereto, all as reflected on the hereinbefore mentioned plan of subdivision.
