Petition for Order to File an Account in Accordance With 20 Pa. CSA ~ 3501.1
NOW COMES Petitioner, Michelle Angela Fogle, by and through her counsel, Law
Offices of Craig A. Diehl, and files the following "Petition for Order to File an Account
In Accordance With 20 Pa.C.S.A. S3501.1" averring as follows:
1. On May 11, 2006, this Honorable Court awarded a Citation directed to Mark
Andreas Fogle, Co-Administrator, Terry William Fogle, Co-Administrator,
and Edward Lee Fogle, Co-Administrator, to show cause why they should not
file an account of their administration of the Estate of Magda Fogle,
Deceased.
2. The Citation was served by the Cumberland County Register of Wills upon
Mark Andreas Fogle on May 30, 2006, upon Terry William Fogle on May 16,
2006, and upon Edward Lee Fogle on May 16, 2006, and the proofs of service
, .
are retained in the records of the offices of the Cumberland County Register
of Wills.
3. No answer has been made by Mark Andreas Fogle, Terry William Fogle, or
Edward Lee Fogle nor have they filed an account.
4. In addition, no estate advertisements have been run, a Pennsylvania
inheritance tax return has not been filed by the Co-Administrators, nor has any
other administrative filing occurred since September 2, 2005.
WHEREFORE, petitioner respectfully requests that this Court enter an Order
directing Mark Andreas Fogle, Terry William Fogle, and Edward Lee Fogle, the Co-
Administrators of the Estate of Magda Fogle, to file an account of their administration
of the Estate of Magda Fogle, Deceased within thirty (30) days after personal service
of the order upon them.
