Plaintiff Dennis Church is an adult individual who resides at 141 Sunrise Drive, Abbottstown, Pennsylvania 17301. 2. Defendant Amanda House is an adult individual who resides at RR#1, Pin Oak Drive, Mechanicsburg, Pennsylvania 17055. 3. On November 8, 2005, Plaintiff Dennis Church and Defendant Amanda House entered into a written contract in which Plaintiff agreed to furnish and install eight (8) double hung "dove" replacement windows for Defendant for the total sum of Two Thousand Dollars ($2000.00). A copy of this contract is attached to this Complaint as Exhibit No. 1. 4. On November 8, 2005, Defendant Amanda House paid Plaintiff Dennis Church the sum of One Thousand Dollars ($1000.00) as per the contract. See Exhibit No. 1. 5. Plaintiff Dennis Church ordered the windows from Blank's Windows in Ickesburg, Pennsylvania on or about November 8, 2005. 6. The windows were delivered to the Defendant's home on November 30, 2005. 7. Plaintiff Dennis Church paid for the windows. The cost of the windows was One Thousand Four Hundred Fifty-One Dollars and Sixteen Cents ($1, 451. 16). 8. On December 1, 2005, Plaintiff telephoned Defendant in regard to a time for him to install the windows. 9. On December 1, 2005, Defendant informed Plaintiff that she was going away, and that this was not a good time. 2 10. On December 6, 2005, Plaintiff left a message for Defendant regarding setting a time for Plaintiff to install the windows. 11. Plaintiff also contacted Defendant in January 2006 to attempt to set up a time to install the windows. 12. On or about the last week of March 2006 Plaintiff telephoned Defendant in regard to installing the windows. 13. At this time Defendant informed Plaintiff that she was going away and promised to telephone Plaintiff when she returned. 14. Defendant never telephoned Plaintiff. 15. On April 29, 2006, Plaintiff Dennis Church and Mr. Earl Cutchall, went to Defendant's residence in the afternoon. 16. Upon arriving at Defendant's residence, someone else was putting in the windows. 3 17. Plaintiff Dennis Church and Mr. Earl Cutchall went around to the backyard and spoke with Defendant Amanda House. 18. Defendant told Plaintiff to get off of her property and to never come back. 19. At this time Plaintiff Dennis Church and Earl Cutchall left the Defendant's residence. 20. Defendant admitted that Plaintiff contacted her on numerous occasions in regard to the installation of the windows. 21. The purchase and delivery of the windows were made at the request of Defendant Amanda House. 22. The prices for the windows and installation of the windows by Plaintiff Dennis Church were fair and reasonable prices at the time and place of purchase and were the prices which Defendant Amanda House agreed to pay. 4 23. Defendant Amanda House has failed to pay Plaintiff Dennis Church the remaining balance owed to him under the contract in the sum of One Thousand Dollars ($1000.00). On November 8, 2005, Defendant Amanda House paid Plaintiff Dennis Church the sum of One Thousand Dollars ($1000.00) as per the contract. See Exhibit No. 1. 5. Plaintiff Dennis Church ordered the windows from Blank's Windows in Ickesburg, Pennsylvania on or about November 8, 2005. 6. The windows were delivered to the Defendant's home on November 30, 2005. 7. Plaintiff Dennis Church paid for the windows. The cost of the windows was One Thousand Four Hundred Fifty-One Dollars and Sixteen Cents ($1, 451. 16). 8. On December 1, 2005, Plaintiff telephoned Defendant in regard to a time for him to install the windows. 9. On December 1, 2005, Defendant informed Plaintiff that she was going away, and that this was not a good time. 2 10. On December 6, 2005, Plaintiff left a message for Defendant regarding setting a time for Plaintiff to install the windows. 11. Plaintiff also contacted Defendant in January 2006 to attempt to set up a time to install the windows. 12. On or about the last week of March 2006 Plaintiff telephoned Defendant in regard to installing the windows. 13. At this time Defendant informed Plaintiff that she was going away and promised to telephone Plaintiff when she returned. 14. Defendant never telephoned Plaintiff. 15. On April 28, 2006, Plaintiff Dennis Church and Mr. Earl Cutchall, went to Defendant's residence in the afternoon. 16. Upon arriving at Defendant's residence, someone else was putting in the windows. 3 17. Plaintiff Dennis Church and W. Earl Cutchall went around to the backyard and spoke with Defendant Amanda House. 18. Defendant told Plaintiff to get off of her property and to never come back. 19. At this time Plaintiff Dennis Church and Earl Cutchall left the Defendant's residence. 20. Defendant admitted that Plaintiff contacted her on numerous occasions in regard to the installation of the windows. 21. The purchase and delivery of the windows were made at the request of Defendant Amanda House. 22. The prices for the windows and installation of the windows by Plaintiff Dennis Church were fair and reasonable prices at the time and place of purchase and were the prices which Defendant Amanda House agreed to pay. 4 23. Defendant Amanda House has failed to pay Plaintiff Dennis Church the remaining balance owed to him under the contract in the sum of One Thousand Dollars ($1000.00).
