COMPLAINT
AND NOW comes the Plaintiff, Erie Insurance Group alslo Thomas H. Wolf and Kelli M,
Wolf, husband and wife, by and through its counsel, Johnson, Duffie, Stewart & Weidner, P,C.,
and files this Complaint and in support thereof, avers as follows:
1, Plaintiff, Erie Insurance Group ("Erie"), is a Pennsylvania corporation with a
primary place of business located at 4901 Louise Drive, Rossmoyne Business Center,
Mechanicsburg, PA 17055.
2. Defendant, Millwood Builders, Inc" ("Millwood"), is a Pennsylvania corporation
with a principal business address of 4 E. High Street, Carlisle, Pennsylvania 17013.
3. At all times relevant hereto, Erie was the insurer of Thomas H. Wolf and Kelli M.
Wolf, husband and wife, ("Wolfs") who maintained a residence located at 390 Pheasant Lane,
Carlisle, Pennsylvania 17013,
4, To the extent that Erie has paid certain sums of money to the Wolfs pursuant to
an insurance policy, Erie is the subrogee of the Wolfs with respect to claims against Millwood.
5, At all time material hereto, Millwood was in the construction business of building
new homes.
6. At all times material hereto, Millwood constructed a new home in 2003, located at
390 Pheasant Lane, Carlisle, Pennsylvania, which the Wolfs purchased.
7, On or about September 12, 2005, a rain occurred which resulted in leakage
around the front entry door of the home causing water damage to the Wolf residence.
8, An investigation revealed a construction defect due to improper door and window
seal causing water leakage.
9. As a result of the door and window leakage caused by Millwood's construction
defect, the Wolf residence sustained water damage and forced them to incur recovery costs.
10. As a result of the aforementioned damage caused by the construction defect,
Plaintiff, Erie Insurance Group, paid the sum of One Thousand, Two Hundred Ten Dollars and
60/100 ($1,210.60) for the remediation and repair of the damage to the Wolf residence,
11. The damage to the Wolf residence, as set forth above, resulted solely from the
construction defect.
COUNT I
NEGLIGENCE
12. Plaintiff herein incorporates by reference paragraphs 1 through 11 as if set forth
at length,
13. The damages suffered by the Wolfs were caused by the negligence of Millwood
in the following respects:
a) by failing to erect and construct the new home properly.
b) by failing to properly supervise and instruct the subcontractors during
construction of the new home,
c) failing to provide proper inspection of the new home before giving
possession to the Wolfs.
14. The aforementioned damage to the Wolf property resulted solely from the
negligence of Millwood.
15. Plaintiff, Erie, as subrogee of the Wolfs, having paid a claim in the amount of
One Thousand, Two Hundred Ten Dollars and 60/100 ($1,210.60) for the remediation and
repair of the aforementioned damage to the Wolf property, is entitled to indemnification by, and
from, Millwood in the amount of One Thousand, Two Hundred Ten Dollars and 60/100
($1,210.60).
WHEREFORE, Plaintiff demands judgment against Millwood in the amount of One
Thousand, Two Hundred Ten Dollars and 60/100 ($1,210.60), together with interest and costs
of suit.
